Study On Assisting Behavior Of Grass-roots System Autonomous Organizations In Epidemic Situation

Administrative Assistance is an important system in the study of Administrative Law in Modern China.It is important to ensure that the administrative body can carry out administrative management smoothly.However,there are some mistakes in our country’s legal norms,most of which are simple and general,it doesn’t have actual Operability.Academic Research on administrative assistance system is not yet complete,there is obvious neglect to social administrative assistance and administrative assistance in emergency,which seriously restricts the construction and development of administrative assistance system in our country.There is a legal basis for grassroots autonomous organizations to assist the Government of the People’s Republic of China in an effort to control the epidemic as soon as possible,The content of the aid is the obligation of the Government of the People’s Republic of China and therefore has the authority to act on behalf of the Government during the aid,in line with the concept of administrative assistance.Therefore,it is necessary to restrict the assisting behavior of grass-roots autonomous organizations through administrative law.The Government of the People’s Republic of China has taken a number of emergency measures to repair the damage caused by the virus.Handling and responding to public health emergencies is not only the responsibility of local governments,but also requires the support and participation of all social forces from all walks of life.The grass-roots autonomous organizations are the main bodies in the emergency prevention and control activities of the new coronavirus epidemic situation,and have contributed an important role in effectively containing the epidemic spreading momentum,at the same time,the assistance behavior of grass-roots autonomous organizations in epidemic situation is also provided by the law of emergency response,which has rationality and legitimacy.Although grass-roots autonomous organizations have played an important role in the prevention and control of the epidemic,some acts went beyond the provisions of the relevant laws,such as hard core village closures,road blockades,mandatory quarantine measures,non-local tenants are prohibited from entering the residential area and divulging the personal information of the registrants.In this paper,the reasons are the thought of privilege remains,the extension of power under the pressure system and the expansion of power under the state of emergency.Therefore,this paper puts forward some solutions for reference.
