The Study On The Crime Of Producing And Selling Counterfeit Baijiu And Its Prevention And Control Countermeasures In China

Baijiu,as a traditional Chinese distilled spirit,has a long history and is a must-have food on the common people’s table.With the economic development and the rise of the wine industry,the output and sales of Baijiu have been increasing.However,driven by interests,the phenomenon of producing and selling a large number of fake and inferior Baijiu is becoming more and more rampant,disrupting the socialist market economic order and infringing on the personal and property safety of the people.Only by grasping the laws and characteristics of its crimes and forming effective prevention and control strategies can we purify the Chinese Baijiu market and curb the chaos of counterfeit and inferior products.From the perspective of criminology,this article analyzes the status,characteristics and typical behaviors of cases through case analysis,statistics and literature research,and finds out the cause of the crime.On this basis,the construction of the prevention and control system of the production and sale of counterfeit and inferior Baijiu in China is analyzed from multiple dimensions.The main body of this article is divided into Five chapters:Chapter One: Introduction.Mainly introduce the research background,research significance,research status and research methods at home and abroad of this article.Chapter Two: An overview of the crime of producing and selling fake and inferior Baijiu in China.Define the concept of Baijiu,the relationship between Baijiu and spirits,the concept of the crime of producing and selling fake and inferior Baijiu,and clarify the research objects.Chapter Three: Analysis of the current situation of the crime of producing and selling fake and inferior Baijiu in China.This chapter mainly counts the cases from 2015 to 2019 published by Itslaw.com,analyzes the overall situation,types of crimes involved,and criminal characteristics of the production and sale of counterfeit and inferior Baijiu in China,and extracts the typical behaviors of the crime of producing and selling counterfeit and inferior Baijiu.The analysis of the causes of crime and the countermeasures of crime prevention and control provide a factual basis.Chapter Four: Analysis of the Causes of Crimes.Combining the rational choice theory,this chapter analyzes the crux of the breeding of related crimes,finds the problems and proposes corresponding effective countermeasures based on the collected materials and cases,starting from the external and internal factors.Chapter Five: Discussion on prevention and control countermeasures.This part combines the actual situation in China,analyzes the reasons for rational choice,draws on the experience of prevention and control outside the territory,uses the three-level crime prevention theory,and establishes a systematic prevention and control system from three levels to curb the crime of counterfeit and substandard Baijiu for reference.
