| Compared with adult criminal suspects,juvenile criminal suspects are in a more vulnerable position in the closed social interaction situation of investigation and interrogation.they are not yet mature in physical development,have natural psychological fragility,and do not know much about criminal proceedings.facing prosecution needs "special protection".The stage of interrogation is the initial stage when minors enter the criminal judicial procedure,and it is the "first button" to protect the legitimate rights of juvenile suspects from infringement and the realization of fairness and justice in legal procedures.However,the law did not give much consideration to the psychological vulnerability of juvenile suspects,and there is a lack of systematic and perfect specific provisions in the aspect of "saving the heart".There is also the problem of insufficient use of non-confrontational interrogation strategies in interrogation practice.In order to implement China’s criminal policy of "educating,influencing and rescuing" and "education first and punishment second",interrogators should carefully analyze the criminal characteristics of minors and probe deeply into the causes of juvenile crimes,be familiar with the confession psychology of juvenile suspects and strictly implement the special protection system for juvenile suspects.The use of interrogation strategies should be in line with the physical and mental characteristics of juvenile suspects.This paper is divided into six parts.The first part is an overview,including research background and significance,research summary,research methods;The second part summarizes the characteristics of juvenile delinquency in recent years and analyzes the causes of crime;The third part puts forward and analyzes the core characteristics of confession psychology of juvenile suspects in interrogation: psychological vulnerability,including the external inducement of psychological vulnerability: the high pressure of interrogation environment,the internal causes of psychological vulnerability: imperfect psychological functional factors such as cognition,emotion and will,and the explicit characteristics of psychological vulnerability: weak legal decision-making ability,strong compliance and be easily hinted.The fourth part is the investigation of the current situation of the interrogation of juvenile suspects,the survey method is to conduct a questionnaire survey on the front-line police handling cases,and the questionnaire is compiled from the two dimensions of confession and interrogation.Based on the analysis of the results of the questionnaire,this part summarizes the common problems in the interrogation practice of juvenile criminal suspects;The fifth part proposes that the system guarantee of interrogating juvenile criminal suspects should be improved,the appropriate adult participation system should be perfected,the psychological intervention mechanism should be drew into interrogation.The sixth part puts forward the strategies and methods of interrogating juvenile suspects.Investigators should first make preparations before interrogation,establish interpersonal attraction and trust during interrogation,use language properly,reduce hints,and use positive interrogation methods to listen to and respond to the confessions and excuses of juvenile suspects. |
