| With the in-depth development of economic globalization and the further strengthened degree of world trade liberalization,various kinds of international economic and trade rules are increasing day by day.But at the same time,global environmental problems are becoming more and more prominent,how to balance economic freedom and environmental protection began to become the focus of attention of all countries.Countries strive to explore the economic development at the same time take into account the environmental protection of the feasible model,and try to embed environmental clauses in various economic and trade rules.After the successful breakthrough in NAFTA to include environmental clauses,it has become an international trend to include environmental clauses in economic and trade rules,and China,as a large developing country,is no exception.Especially in the current China actively promote "area" initiative,continue to strengthen along with the state economic and trade cooperation between the background,the implementation of China with the foreign transfer of backward production capacity,to "stigmatized" accused of pollution transfer,therefore,China must consider further shaping the environmental clauses in the international economic and trade rules,balance the interests of all parties for the sustainable development of economic and trade activities."One Belt And One Road" initiative itself,meanwhile,also with China to promote bilateral or multilateral way international rules shape function,concerned about the environment rules for the future of the implementation,not only helps to reduce initiative to participate in the country to China,can in order to promote China on a new generation of voice and influence in international economic and trade rules provide new breakthrough.This paper focuses on the analysis of environmental clauses in economic and trade rules,tries to sort out the evolution history and main types of environmental clauses,and analyzes their inherent advantages and disadvantages.Based on the practical experience outside China,this paper puts forward some feasible suggestions on improving the environmental clauses in China’s economic and trade rules.The full text is divided into the following four parts: the first part briefly introduces the current situation of environmental protection clauses in international economic and trade treaties,starting from the significance of including environmental protection clauses in international economic and trade treaties,combs the main types of environmental protection clauses in international economic and trade treaties,and lays a theoretical premise for the whole text.The second part combs the development and changes of the environmental protection provisions in the current influential international economic and trade treaties and carries out comparative analysis,points out the substantive characteristics and evolution direction of the environmental protection provisions,and evaluates the relevant environmental protection provisions from a dynamic perspective,so as to pave the way for the following analysis of China’s situation.The third part focuses on China,summarizes the environmental protection clauses in various international economic and trade treaties signed by China,and summarizes four problems:narrow coverage,vague wording,lack of necessary content and conflict with other clauses.The fourth part combines the practical experience at home and abroad,summarizes China’s due position based on China’s national conditions and development needs,and puts forward feasible suggestions to improve the environmental protection clauses in China’s economic and trade agreements from the content of the clauses and the safeguard system,so as to promote China to give consideration to environmental protection in the process of investment and trade liberalization,so as to achieve sustainable economic development. |
