Research On The Administrative Law Of The System Of Settling Points

The city council registered residence in 2014,and put forward the proposal that the urban population with a population of 5 million or more should be established in order to achieve the registered residence system reform and promote the citizens stability a nd stability in the city.In this context,Beijing,Shanghai,Tianjin,Chongqing,Guangzhou,Hangzhou,Harbin and other 15 cities have proposed the integral settlement system,which is playing an important role in various cities.The system of registered residence is the main force of household registration reform system.Major city has issued relevant normative documents to implement the system.However,there are still some problems in the process of text stipulation and concrete implementation.The standard setting of integral management system is still regulated,which is manifested in the confusion of integral index standards and violation of the principle of proportionality.The difference of integral scores is too large,which violates the principle of rationality and the total index of settlement is too low;As the main carrier of the credit settlement system,normative documents lack public participation in the formulation process;The procedure of relative person applying for settlement is inefficient,which does not meet the requirements of the principle of high efficiency and convenience;The relevant relief system of the integral settlement system is not perfect,including its relief way is not clear,and the internal accountability mechanism of the administrative organ needs to be improved.These problems affect the effective implementation of the system of integral settlement.If it can not be further improved,it will not be conducive to the deepening and development of registered residence reform system.This paper makes a theoretical and empirical analysis of the integral settlement system by sorting out normative documents and collecting the settlement situation of various cities.First,starting from the origin of the system of integral settlement,the background of the system of integral settlement is introduced in detail,and its essence is the product of the transformation from two yuan registered residence system to one yuan registered residence system.Secondly,it interprets the relevant texts of the settlement of points system,and analyzes that the legal nature of the settlement of points is administrative confirmation in the form of normative documents;The system follows the principles of equality,openness and legality,and establishes a clear index system.Then,the effectiveness of the integration settlement system is summarized,which not only promotes the reform process of registered residence system,enhances the citys soft power,but also helps to promote equalization of public services and protect the human rights of citizens.On this basis,this paper makes a comprehensive analysis of the integral settlement system,and analyzes the problems existing in the text and implementation process of the integral settlement system.Finally,we should standardize the management index system of points,introduce public participation methods such as hearing system,improve the efficiency of the implementation of points settlement system and improve the relevant relief system.
