Research On National Defense Patent Decryption Legal System

National defense technology is a country ’s main strategic area and a more concentrated and higher-level scientific and technological innovation area.Since 1990,China has established a national defense patent system in accordance with the National Defense Patent Regulations of the People ’s Republic of China(hereinafter referred to as the National Defense Patent Regulations).However,for many years,the country has paid attention to the research and development of national defense patents,but it has neglected the decryption and conversion of national defense patents,resulting in a large number of national defense patents being backlogged and wasting huge manpower and material resources.The reason is that the above-mentioned unfavorable consequences are due to the unreasonable design of China’s national defense patent decryption system,which is mainly manifested in: the law is too principled for decryption,the operability is not strong;the decryption is unreasonable;the decryption supervision system is not perfect;other supporting facilities The mechanism is not perfect and so on.The above-mentioned various factors have led to China’s defense patent decryption system has been unable to adapt to the development of today’s world,therefore,China’s defense patent decryption system needs to be improved.Under this background,combined with China’s current military-civilian integration strategy,this article first introduces the theoretical basis of China’s national defense patent system,explains the meaning of national defense patent decryption,and analyzes the significance of decrypting national defense patent decryption.Secondly,it focuses on the current situation of China’s national defense patent system,and analyzes the implementation of the decryption and transfer of national defense patents,and explores the outstanding problems of our country’s system.Again,this article will introduce in detail the defense patent decryption system of typical foreign countries,summarize the characteristics of national defense patent decryption legal systems and the transfer and transformation mechanism,and extract the experience of this foreign system to improve China’s outstanding problems.Finally,on the basis of combining China’s national conditions and drawing on foreign excellent experience,put forward countermeasures to improve China’s national defense patent decryption system,formulate practical and feasible legal measures and provide for the establishment of a new system suitable for China’s national defense patent decryption,and to achieve the in-depth integration of military and civilian development Good legal environment.
