Research On The Distinctiveness Of Sound Trademark

This article studies the distinctiveness of sound trademark.This paper sums up the legal stipulation of sound trademark distinctiveness,putting forward the constituent elements and explores the classification,which also studies the examination and protection of sound trademark distinctiveness.Through the literature studying and using case analysis method,the second and the third chapter analyzes the definition of sound trademark distinctiveness.The laws and regulations on the sound trademark distinctiveness are generally taken into account in the legal provisions of trademark distinctiveness.Semiotics,cognitive psychology and logic provide the basis for the legislation of sound trademark distinctiveness.The constituent element of sound trademark distinctiveness are the identifiable form of sound mark and the definite source of sound trademark.The classification of sound trademark distinctiveness can draw the conclusion that common sound,functional sound and universal sound are not significant,and clarifies the protection range of different sound trademarks.Through the empirical investigation method and literature reading method,the IV chapter analyzes the examination of sound trademark distinctiveness.There are many applications for registration of sound marks in China’s mainland,only less of sound marks can get registrations.Sound trademark registration should not be required by originality.The content of sound trademark cannot violate the prohibition clause,cannot exist the conflict of rights or has the negative influence.This chapter also make the conclusion of brief sound mark,note sound mark and sound mark containing trademark words,adjusting the standard of the use of sound trademark.The last part suggest the registration of sound marks should take the average consumer’s perception level as a perspective,using the censor’s intuition to determine the relevant public,combining different forms of use of the mark,and adopts the method of questionnaire.The final chapter discusses the protection of sound trademark distinctiveness.Failure to satisfy any of the constituent elements can cause the loss of sound trademark distinctiveness.The distinctiveness protection of sound trademark only for the sound trademark distinctiveness which has been established.Well-known sound trademarks should have the higher intensity of protection.Perfecting the legal articles of trademark distinctiveness,providing extra protection for well-known sound trademarks and effectively managing sound trademarks are the ways to protect sound trademark distinctiveness.
