Abstract/Summary:
Under the background of big data era, technology become more and more developed, and people’s dependence on electronic technology information technology and related products is increasing day by day.Things have the characteristics of universal connection. The mutual integration and promotion between different industries will accelerate the overall development of society.Under the background of this era, emerging industries such as "network ride-hailing" gradually emerged in people’s vision and rose rapidly in an irresistible trend.Compared with the traditional taxi industry, the "network ride-hailing" industry has a considerable advantage.First of all,the information directly connects the time of the driver’s tour and the waiting time of the passengers.Secondly, this technology supports the "advance booking" function, which is convenient for passengers to travel efficiently, and also provides a reasonable reference path for people to arrange their own time. However, everything is two-sided.When new things appear to bring benefits topeople, there must also be potential hidden dangers. On the one hand, although China’s Ministry of Communications, including the Ministry of Public Security and other seven ministries and commissions promulgated the "Interim Measures for the Administration of Online Appointment Taxi," its level of effectiveness and its content are still to be improved, and there is a lack of legal regulation at the relevant legal level, leaving certain laws.Blank areas may even lead to "cannot be depended on" situations. On the other hand,China’s vast area and regional development are very different, and there are certain regional differences. From the analysis of existing legal norms, each city’s document based on its owndevelopment may not be able to effectively supervise the development of new industries.Inadequate government supervision will become a constraint to future industry development. The topic of this article mainly expounds the development status of our country’s“Networking Vehicle” industry and the existing legal regulations. It analyzes the existing legal regulations in China from both central legislation and local legislation. In addition, the network about the car industry was first established in foreign countries, and the attitude of foreign countries regarding the “about network car” is also very different. However, generally speaking, the regulation of existing online car industry in foreign countries is relatively complete, and it is relevant for China’s relevant legislative studies. This article mainly discusses the different practices of the United States,Britain, and France in treating this industry, and integrates it based on the country’s existing national conditions and the development trend of the industry.Combining the differences between China and the West, and comparing and drawing on the legal regulations and a series of practices in countries with similar national conditions, the paper concludes the suggestions and explorations of the Internet-based taxi legislation so that emerging industries can better adapt to the development of society and bring convenience to people’s lives.
