Research On The Legal System Of International Civil Aviation Carbon Emission Reduction

In response to global climate change,controlling carbon dioxide emissions has become an effective means to mitigate climate change,effectively allocate atmospheric resources in the environment,and balance the interests of developed and developing countries.According to statistics,among all kinds of transportation industries that emit greenhouse gases globally,the international aviation industry has accounted for 2% of the total man-made carbon emissions in the world.According to the international civil aviation organization,global aviation carbon emissions are expected to increase three to seven times by 2050.Therefore,effective control of carbon dioxide emissions from aviation is the only way to mitigate global climate change;It is a beneficial practice for China to participate in the carbon emission reduction process of a single global industry to study the corresponding aviation carbon emission reduction system.Regulation of carbon dioxide emissions from aviation has been part of the rules since the United Nations framework convention on climate change,the Kyoto protocol,the Chicago convention and the Paris agreement.With the vigorous promotion of the EU and ICAO,the international civil aviation carbon emission reduction legal system is gradually taking shape.The research on the legal system of carbon emission reduction of international civil aviation mainly lies in the discussion on the setting of emission reduction target,the selection of emission reduction plan and the supervision of emission reduction results.At the same time,according to the situation of China’s domestic carbon market,this paper analyzes the opportunities and challenges brought by the international aviation carbon emission reduction system to China,and puts forward corresponding solutions.At present,China is in the early stage of the construction of the carbon market,and various rules and operating mechanisms,such as carbon dioxide monitoring,verification and other key technologies,need to be improved.Therefore,China should actively participate in the international aviation carbon emission reduction system rules,adhere to the principle of common but differentiated responsibilities and respective capabilities,and put forward the interests of developing countries;At the same time,the effective link between the international and domestic aviation carbon markets should be promoted.In addition,it is necessary to strengthen the legislation and capacity building of the domestic carbon market,improve the market coverage of the domestic aviation industry,strengthen the introduction of relevant legal rules and policy supporting mechanisms,and do a good job in the assessment and preparation of major aviation enterprises,so as to draw on favorable experience for the construction of China’s carbon market.As an important contributor,participant and leader in addressing global climate change,China should play a leading role in international aviation carbon emission reduction actions and contribute to the mitigation of global climate change.
