| The revision of the Administrative Procedure Law in November 2014 was a milestone event in the development of China’s administrative litigation system.It also has far-reaching significance in promoting the development of the administrative review system in China.The introduction of the joint defendant system was the most important thing among the series of amendments involving the administrative reconsideration system.This measure has solved the problem of persistently high maintenance ratios in administrative reconsideration,and has made it possible to get rid of the shackles.In addition,practices show that in recent years,the administrative reconsideration system has continued to develop in the course of reforms and the implementation of a number of initiatives has achieved initial success.Relatively concentrated administrative reconsideration pilot program has been basically stable,and the operation of the administrative reconsideration committee system is also worthy of recognition.It is worthwhile to think that how to make the administrative reconsideration more convenient and effective facing with the new situation under the new situation so that it can be used to its maximum effectiveness.Of course,even though the effectiveness of the reform has been affirmed,we must also face up to the problems which emerged in practice in recent years.For example,the joint defendant system and various new types of reconsideration cases have brought great pressure on reconsideration authorities.Relatively concentrated reconsideration pilot program did not play the expected role in the grass-roots counties and so on.The purpose of this paper is to analyze the existing problems of the administrative reconsideration system and provide suggestions to make the new and old system better transition and convergence,so that it will further deepen the reform and develop and improve it.This paper is mainly segmented into five parts:The first part expounds the selection of subjects background,research status,innovation point and research significance of the proposed issue,and it is cited as the introduction.The second part briefly outlines the concept of the administrative reconsideration system and the distinction between similar concepts,the nature of the administrative reconsideration,and the functional features,lays the theoretical foundation for the subsequent writing.The third part mainly summarizes the status of the domestic and extraterritorial administrative reconsideration system,analyzes the problems existing in the administrative reconsideration system at the current stage and the current situation of the administrative reconsideration as a joint defendant system,and also summarizes the current model of the development of administrative reconsideration outside the domain as the following Transition.The fourth part mainly focuses on the features of administrative reconsideration in Shijingshan District of Beijing,bases on the latest institutional development status and corresponding data information.Hoping to provide some experience and enlightenment to China’s administrative reconsideration system.The fifth part is based on the existing issues mentioned above,and the author pertinently put forward the overall and local perspectives in order to promote the improvement and development of China’s administrative reconsideration system. |
