The Realistic Dilemma And System Improvement Of Civil Service In China

The civil service system is often regarded as a simple transactional work of the people’s court in legislation and justice.In fact,it is a bridge and link connecting to all aspects of civil litigation.On the one hand,effective civil service can timely inform receivers the content of the litigation documents,urge them to exercise their litigation rights,fulfill their litigation obligations actively,and protect their legitimate rights and interests.On the other hand,efficient and standardized civil service can guarantee the smooth progress of the proceedings and the fairness of trial results.At present,the people’s courts are in a judicial environment of “there are many cases and fewer people”.The heavy burden of service affected the trial efficiency of the court severely.The irregular service also does harm to the parties’ litigation rights.The focus of this article are the problems of civil service and how to resolve the dilemma of civil service.First of all,this paper examines the current status of the service system in judicial practice through empirical research.It is found that there are problems in the operation of the seven legal service methods,and these problems are intuitively and thoroughly displayed in the form of charts.Then it analyzes the causes of the "difficult service" problem from the four levels of objective environment,citizens,courts and legislation.In the end,this paper proposes seven countermeasures to resolve the service dilemma addressing the problems and causes.It proposes innovatively to build a delivery mechanism that focuses on "serving in court and assisting in serving the subject".It specifically demonstrates how to build a big data information sharing platform in the context of the rapid development of new media,and find a breakthrough for solving the plight of civil service.I hope this article can provide some ideas and help for improving China’s civil service system,so that the court’s trial work can be improved,the trial pressure can be eased,and the procedural and substantive interests of the litigants can be guaranteed,so as to steadily promote judicial reform and create a good judicial environment.
