Study On Improving The Filing And Review System For Normative Documents Of The Standing Committees Of Local People’s Congresses

The filing and review of normative documents is a constitutional supervision system with Chinese characteristics,which is more conducive to the supervision function of the Standing Committee of the National People’s Congress.The filing and review of normative documents is not only a reference to the normative work of the drafting authorities,but also an important institutional arrangement to safeguard the unity of the national legal system and the legitimate rights and interests of citizens.The filing and review system for normative documents of the standing committees of local people’s congresses is an innovative system designed by the standing committees of local people’s congresses at various levels to supervise local legislation.The filing and review organs cooperate with the drafting organs of normative documents to carry out the filing and review work in accordance with the institutional norms and give play to the functions of the system itself.Through the practice of the development of the system to improve the continuous exploration,has stepped forward to a good direction.However,there is still a gap between the design expectation and the actual effect of the current system,and the system tested by practice still needs to be improved in many aspects.In this paper,the filing and review system of normative documents of the standing committees of local people’s congresses was taken as the research object,and the normative regulations and work reports of the standing committees of local people’s congresses were searched and analyzed through the Internet.In combination with typical cases,the legal provisions and actual operation status of the filing and review system of normative documents of the standing committees of local people’s congresses were learned,the shortcomings of the current system were found out,the causes of the problems were analyzed,and suggestions for improvement were sought from the perspectives of formulating legal norms for filing and review of normative documents,improving relevant procedures,and ensuring the effective operation of the system.This paper focuses on the overview of the system,the legislative regulation and case analysis,the analysis of the shortcomings and causes,and the relative improvement suggestions.In addition to the introduction and the conclusion,this paper is divided into four chapters to discuss the "improvement of the filing and review system of normative documents maintained by local heads of people’s congresses.The first chapter mainly puts forward the basic characteristics of normative documents,which can be used as one of the bases for whether to be included in the archival scope.At the same time,the other related concepts of the system are defined,and the development process of the system is briefly sorted out.At the same time,the significance of the existence of the system is expounded.The second chapter starts with the regulations and practices of the standing committees of provincial people’s congresses on the filing and review system for normative documents and the work of provinces,cities and counties,and analyzes in detail the cases of the standing committees of 22 provinces,4 municipalities directly under the Central Government and 5 autonomous regions on the filing and review system for normative documents,so as to fully grasp the current operation status of the system.The third chapter explores and summarizes the deficiencies of the normative document filing and review system of the Standing Committee of the Local People’s Congress in terms of legal regulations,working procedures and relevant mechanisms of the operation of auxiliary systems at the present stage,and analyzes the causes of such problems.Chapter iv exploratory in view of the current place National People’s Congress standing committee of the normative documents for the record review system in our country are put forward according to the existing problems in the legislation and practice perfect plan.Hope this article’s point of view to improve the place National People’s Congress standing committee of the normative documents for the record review system,and promote the record review to provide intellectual support.
