| As one of the economic products promoted by modern science and technology,the sharing economy has shown strong development potential in recent years.This is a new economic model that relies on network technology.It is different from the traditional economic model.It has unique Organizational structure,transaction mode,operation mechanism meet management method.When the traditional economy was at a low development stage,the sharing economy was born,spreading and infiltrating all aspects of society at a very fast development speed,entering every aspect of people’s daily life,and becoming an indispensable part of people’s lives.First,it has also injected a new force into the development of society and economy,and has played an increasingly important role in the national economic structure.In the sharing economy,the important feature consistent with its name is "sharing",which is also an important feature of this new economic model.It realizes the concentration of idle resources or surplus materials of society and people and distributes them to those in need.It can be said that most of the traditional economic model is that people or companies have needs and then look for resources,while the sharing economy is where the society’s idle materials actively seek out companies or individuals in need.It is undeniable that the rapid development of the sharing economy has injected new vitality into the social and economic development and enriched the national economic structure,but it has also brought many problems,such as consumer privacy protection,user data protection,user right to know,and compensation.Rights issues such as rights,security,social management issues,and economic behavior supervision issues have all brought certain challenges to my country’s existing laws.In this context,this article deeply analyzes and explores these problems in the sharing economy,and studies the protection of consumer rights in the sharing economy through empirical analysis,case analysis,normative analysis,and literature research.First,it explains the current domestic and foreign research status of this subject,and sorts out the existing research results;secondly,it introduces the basic connotation and characteristics of the sharing economy,and analyzes the current development situation of the sharing economy in China,including the development process,the status quo,and the current laws of our country.The lagging nature of the above;then in-depth study of the problems in the protection of consumer rights under the sharing economy,such as the difficulty of realizing the right of compensation,the difficulty of guaranteeing the right to safety,the infringement of the right to fair trade,and the damage to the right to know,etc.,and analyze these problems The basic reasons for the existence are mainly due to the low level of legislation in the sharing economy in China,the insufficient legal system,the unclear judgment of the responsibilities of all parties in the sharing economy,the lack of long-term effective supervision measures by the government,the awareness and cost of consumer rights protection,etc.Finally,in response to these problems,corresponding improvement suggestions are put forward,such as the need to build a legal system for consumer rights protection,clarify the responsibility of the sharing platform,innovate the government’s supervision methods and mechanisms,improve the user information protection mechanism,and guide and strengthen the platform Responsibility for the protection of user information,increase consumer awareness of rights protection,reduce the cost of consumer rights protection,and enhance the sharing concept and cultural literacy of the entire society. |
