Research On The Legislative Model Of Barrier-free Environment Construction In China

At the National Day military parade on the 70 th anniversary of the founding of the PRC,we can notice some changes: the “disabled” was changed to “the disabled” in the host population broadcast;Convenient travel for the disabled has been included in the scope of a better life.protecting the convenience of people with disabilities and enabling them to participate social life has become a hot spot of current concern,and the barrier-free environment has become the best response to this hot spot,because it’s a guarantee for people with disabilities to participate social life,but also a sign of the progress of urban civilization.At present,great progress has been made in construction of barrier-free material environment in China.However,there are still some major problems in China’s barrier-free legislation,such as the lack of barrier-free law;the existing barrier-free-related laws have varying effective grade,poor convergence and conflicts.The model of barrier-free legislation plays a decisive role in the whole legal system and legal norms of barrier-free.So we must deeply study the legislative model of barrier-free environment construction in China.In this article,the author will first define the concept of barrier-free,barrier-free environment and legislative mode;then classify the barrier-free legislative mode from three aspects of legislative form,legislative value and legislative method,It can be divided into comprehensive and decentralized mode from legislative form,welfare model and right model from legislative value,executive-led and public-participated legislative model from legislative method,and introduce the Canadian comprehensive Legislative model,Italian decentralized legislative model,Japanese welfare model,American rights model,Swedish executive-led legislative model and British public participation legislative model;then analyzes that China’s barrier-free legislative model belongs to the decentralized legislative model,the welfare model,and the executive-led legislative model and points out these three existing problems in the legislative model;Finally,the choice of my country’s barrier-free legislation is proposed from three aspects.
