Study On The Path Of Service Labor Reform In Prison Enterprises

Under the new situation,the Ministry of Justice proposed to develop a pattern of "five major transformations",which put forward a higher new requirement for prison work.Prison enterprises,as carriers of work of criminals reform,should comply to the new situation and new requirements,give full play to the grasping role of labor reform and ensure social benefits first while taking economic benefits into account.General Secretary Jinping Xi pointed out that "the diathesis of laborers is of great significance to the development of a country and a nation.The team of skilled workers is an important foundation to support China’s manufacturing and creation,which plays an important role in propelling high-quality economic development.The purpose of prison work is to remould people.And prison enterprises which take the reform of prisoners as their main duty and business should serve the reform work,and exports "qualified products"to the society as the ultimate goal.so how to transform more criminals who love leisure and hate labour into excellent workers who fling themselves into high-quality economic development.We will return prisons to their essential functions,promote social equity and justice,and ensure that people live and work in peace and contentment.However,at present,the reform of the prison system of"separating prison from enterprise" has prompted prison enterprises to embark on a relatively independent development road.In the process of development,prison enterprises are affected by policies and environment,which can not balance the relationship between prison economy and labor reform,resulting in the low ability and level of service reform of prison enterprises.This paper analyzes the current situation,problems and causes of the prison enterprises in E province serving the labor reform,by using various methods such as comparative analysis,literature research,investigation research.Combined with the research achievements of scholars at home and abroad,applying the new public service theory and the theory of criminal reform through labor,this paper highlights the word "service",which helps prison enterprises to better perform the service function of labor reform.What’s more,“service” helps to improve the efficiency of labor reform.In terms of how to weaken the economic attribute of prison enterprises and strengthen the attribute of labor reform in prison enterprises,this paper puts forward the following suggestions: complete laws,regulations and policies;improve the governance ability of prison and prison enterprises.Establish a reform-through-labor system;construct a resource allocation system for reform-through-labor;realize the optimal allocation of resources for prison enterprises under our jurisdiction;Improve the rights and interests protection system for criminals’ labor reform;organically integrate labor rights and interests such as remuneration,working hours,posts,and labor security;improve the efficiency of labor reform;Establish an early warning feedback system;collect existing problems in time analyze problems and solve problems;connect up and down,and communicate immediately to ensure timeliness.Establish labor reform index and assessment system to guide the healthy development of prison enterprises.Furthermore,it also suggests: constructing the operation mode of prison enterprises with star topology structure,clarifying the specific functions of prison enterprises at all levels,establishing the responsibility of higher prison enterprises to improve the profitability of the entire prison enterprise group,strengthening the efficiency of the operation of lower prison enterprises through internal assessment,achieving positive competition within lower-level prison enterprises,reducing lower-level prison enterprises which directly are exposed to market competition,and putting labor reform as the main business and meanwhile realizing the economic goals.The innovation of this paper is to establish the operation mode of prison enterprises with the star topology through the construction of four systems,so as to promote the advancement of prison enterprises in serving criminals through labor reform all the time.
