In recent years,there have been frequent incidents of people with mental disorders and major violent cases involving people with mental disorders.The society’s attention to the group of people with mental disorders has been increasing year by year.In order to solve the problem of admission and treatment of patients with mental disorders who caused accidents,the improvement and standardization of the compulsory medical treatment system has become the focus of attention from all walks of life.In 2012,my country revised the Criminal Procedure Law and made relevant provisions on the compulsory medical treatment system.It has indeed played a role in rationally admitting and treating people with mental disorders who have caused accidents and maintaining social security.However,judging from years of practice,there are still some problems.Among them,the difficulty of resocialization of compulsory medical personnel is particularly prominent.Through literature analysis and in-depth interviews,this paper uses social governance theory,social support theory,and social integration theory to conduct indepth research on the status quo of compulsory medical treatment and the resocialization of compulsory medical personnel in J City,Shandong Province.The study found that City J has formed a system for the admission and management of compulsory medical personnel,and certain results have been achieved in the management of compulsory medical personnel after the dismissal,especially in terms of medical treatment,hospitalization,economic assistance,and social management and control.The patient’s condition is treated and controlled,the financial burden of the patient’s family is reduced,and the risk of secondary accidents is reduced.However,in the process of re-socialization of compulsory medical personnel in J City,there are still problems such as government measures focusing on management and neglecting care,lack of social communication,low employment rate,and low income of compulsory medical personnel.Through in-depth research,it is found that there are four main reasons for these problems: First,from the perspective of individuals and families,the lack of social interaction and the lack of employment rights protection for the compulsory medical personnel,the family is difficult to solve their psychological problems,and the science of helping and guiding them Insufficient sex.Second,from the perspective of government management,laws,regulations and intervention mechanisms are not sound,there is a lack of effective linkage mechanism among management subjects,and the management team lacks professional standards.Third,from the perspective of social organization participation,the ideas and concepts of social organization participation have not been formed,community service resources are scarce,and the ability of social organizations to function first.Fourth,the government,social organizations,and families have not formed a reasonable cooperative governance mechanism.On the basis of analyzing the problems and the causes,drawing on the advanced experience of the management and re-socialization of compulsory medical personnel at home and abroad,some suggestions are made for the re-socialization of compulsory medical personnel: First,the government should establish and improve a long-term mechanism for the re-socialization of compulsory medical personnel.The second is to guide and encourage social organizations to participate in the initiative and enthusiasm of compulsory medical personnel to re-socialize.The third is to give play to the important role of the family in the re-socialization of persons subject to compulsory medical treatment.The fourth is to explore the establishment of a collaborative governance mechanism among the government,social organizations,and families. |
