A Study On The Legal Administration Of The Executive Branch In Licheng District

As the lowest level of government,Grassroots Government of the People’s Republic of China is the main body of implementing and executing national policy and tasks from higher Administrative Department in charge.Many problems will arise in its process of exercising administrative functions and powers.Among these,administrative problems in accordance with the law is an aspect worth discussing.To afore-mentioned problem,the most effective way to solve is to resort to the force of law.In recent years,China’s basic strategy of running the country by law has been fully implemented and gradually deepened,which has enabled China’s various systems to be fully implemented.On the social level,China’s People’s concept of the rule of law is gradually strengthening.So are People’s requirements for the rule of law.In the face of this situation,the work of the grassroots Government of the People’s Republic of China has been given more stringent requirements.Meanwhile,with the establishment and improvement of the administrative legal system,in particular the revision of the new administrative procedure law in2014 and the subsequent introduction of relevant judicial interpretations,it has become even more important for the people to safeguard their legitimate rights and interests through administrative litigation and provided the full legal foundation and the system safeguard.With the increase in the number of administrative litigation cases,the executive branch’s level of administration according to law can be reflected by administrative litigation cases within a certain region and a certain period of time,it is a practical reference for the executive branch to improve the level of administration according to law.At present,most of the research on the grass-roots government administration according to law is carried out by the documents,data and some events related to the government,or explained by the pure theoretical research.Through the analysis of a certain number of administrative litigation cases in a certain district,although the scope is relatively small,the content is relatively specific and the angle of reflection is unique compared with the study mentioned above.It can also reflect the problems of administration according to law in a certain period and a certain development stage,and the suggestion is more reasonable and operable than the pure theoretical research.This paper analyzes the selected administrative litigation cases in terms of the types of cases,the changes in the number of cases,the results of the decisions,and the cases involved,etc.and through the cases’ situation to find out the current administrative problems of the executive branch under the Licheng district in accordance with the law,and then analyze the causes from the the two major(internal and external)aspects.The internal causes include the problems of civil servants at the grass-roots level,the problems of internal supervision and accountability mechanism to be improved,and the external causes include the imperfect laws and regulations and the change of citizens’ legal consciousness.Combining with the related theoretical knowledge of administration according to law,this paper probes into the ways to improve the administration according to law in the jurisdiction area from the aspects of legislation,the construction of public servants,the perfection of the supervision mechanism and the exertion of the function of Administrative Litigation.In particular,the role of the administrative litigation,from the basic role of the administrative litigation,the perspective of the judiciary and the perspective of the executive branch itself,has been discussed in detail.In order to raise the level of executive branch administration according to law in the region,this paper can also make certain recommendations.
