Study On Improving The Leading Role Of Local People’s Congress

The rule of law is an important symbol of the progress of human civilization and a basic way of governing the country.Legislation undoubtedly plays the most important and fundamental role in all parts,including legislation,law enforcement,judicature,and law-abiding.People’s congress is the legislative body empowered by the constitution.The party and the state have repeatedly put forward deployment requirements for playing its leading role in legislative work.Laws and regulations have also clearly stated that playing the leading role of the people’s congress in legislative work has become an important indicator for judging the quality of legislative work.What is the leading role of People’s Congress in the legislation? It can be understood as the People’s Congress and its Standing Committee with the statutory legislative power plays a leading,promoting,and decision-making role in the whole legislative process and various aspects such as advancing legislative procedures and determining laws and regulations under the legislative work framework of "party committee leadership,People’s Congress domination,government support,and participation of all parties" through the organization and coordination of legislative work.Adhering to the people’s congress to lead legislation is an inherent demand and inevitable requirement for realizing democratic principles,fully advancing the law-based governance,overcoming the legalization of departmental interests,and improving the quality and efficiency of legislation.On the other hand,our country’s legislative practice is affected by various factors such as the legislative system and mechanism,the development of legislative power,and the will and ability of legislators.The leading role of the people’s congress in legislative work is not fully fulfilled.Compared with the National People’s Congress,the leading role of local people’s congresses in legislation is weaker.Most of them stay at the system call level,and the actual implementation is not good enough.To this end,this article takes the promotion of the leading role of local people’s congresses as the research content,selects the 2016-2020 legislative work of Jilin Province as the research sample,summarizes the beneficial experience gained by the provincial people’s congresses with local legislative powers in leading legislation,analyzes the existing shortcomings and the reasons,and then proposed ways to enhance the leading role of the local people’s congress legislation.The legislative leadership of the People’s Congress should position in organization and coordination,take handling well the relationship with the party committee,government,and the public as the principle,and promote the cooperation among all parties.We should establish a scientific regulatory project,the formation of multiple drafts,in-depth legislative research,adequate review of laws and regulations,perfect implementation supervision,and effective legislative propaganda mechanism led by the People’s Congress and promote the effective play of the leading role through institutional norms.We should focus on improving the legislative ability of people’s congress deputies,standing committees and special committee members,and legislators and promote the enhancement of the legislative leading ability of the local people’s congress.
