Research On Infringement Liability Of Autonomous Driving Vehicles

How to promote artificial intelligence to actively integrate into social life has caused fierce debates in the scientific and technological circles and legal circles.When autonomous driving technology has achieved breakthrough development,the lag of the law has begun to appear.Questions such as the Autonomous driving test process,the legal subject qualifications of Autonomous driving,and the assumption of legal responsibilities also follow.A sound autonomous driving legal system and mature policy framework are good for autonomous driving.The latest exposure draft of the "Road Traffic Law" has made guiding provisions for autonomous driving testing and liability sharing,but the current legal system does not involve the issue of liability for damage caused by autonomous driving.In terms of specific content,whether autonomous vehicles can be applied to the determination of tort liability of traditional vehicles,and whether they can obtain the qualifications of civil subjects and infringement subject need be discussed by the academic circles.In order to solve the above problems,this paper first analyzes the origin and connotation of autonomous driving vehicle,and then analyzes the challenges brought by the autonomous driving vehicle to the current law.Combined with the current situation of the legal regulation of autonomous driving abroad,this thesis believes that the development of China’s autonomous driving vehicle should strengthen the cooperation between regions and industries,and actively promote the revision and adjustment of laws and regulations.In the long run,we should balance the relationship between the development of science and technology and the interests of the public.This thesis considers that autonomous driving vehicle should be a special thing and be regulated by special laws.From the responsibility sharing,this thesis believes that under the existing fault liability and product liability,we should adjust the main responsibility and liability principles,introduce the matching insurance system appropriately,and seek the balance between evidence collection and privacy protection to cope with the challenges brought by automatic driving technology,and promote the healthy and orderly development of autonomous driving vehicle.
