| Article 11 of the "supervision law" endows China’s supervisory committee with the function of preventing corruption,which can be divided into supervisory responsibility,anti-corruption education responsibility and supervisory recommendation responsibility.In the process of preventing corruption,the supervisory committee can limit the public power through supervision,eliminate the preconditions of corruption,and reduce the opportunities of corruption;Through the education of clean government,we can reverse the thoughts of the public servants and eliminate the motive of corruption;We can make and issue supervision suggestions to plug the loopholes in the system of the relevant units,prevent the national public officials from taking advantage of the loopholes in the system to seek private interests,and reduce the opportunities for corruption.Although the corruption prevention work of the supervisory committee has achieved certain results,the existing studies show that the supervisory committee has not yet performed this function well.The paper points out that the supervision committee can’t effectively supervise all public officials only relying on the supervision committee under the current "full coverage" principle and direct supervision mode;The effectiveness of resident supervision has not been fully released;The effectiveness of the anti-corruption education system needs to be improved;The educational system of clean government does not make good use of new technology;There is a lack of scientific and reasonable evaluation methods in the anti-corruption education system;The supervision suggestion lacks the relief procedure and so on.In order to better construct the system and mechanism of "dare not corrupt,can not corrupt,do not want to corrupt",and to better solve the problem of corruption increment,the paper suggests that the supervision committee should further enhance its supervision ability,learn from the criminal compliance system,and change the supervision thought and mode;To set up supervision measures in specific areas.In view of the function of anti-corruption education,the supervisory committee should improve the anti-corruption education system on the basis of new technology,and build a reasonable evaluation system of anti-corruption education.In view of the function of supervision suggestions,the supervision committee should further clarify the reasons and specific procedures for not adopting supervision suggestions by formulating supervision laws and regulations.At the same time,the hearing link of supervision suggestions should be added.Only in this way can we further enhance the effectiveness and pertinence of corruption prevention. |
