On The Legal Responsibility Of The Entrusted Organization In The Administrative Commission

Due to the limited internal structure and personnel of administrative organs,they cannot fully meet the needs of social development.So to improve the efficiency of government work,administrative entrustment jumped,however as administrative sectors covered by the more and more comprehensive,which all lead to the expansion of the entrusted scope and content,and to many of the entrusted organ,organization and individual instead of the administrative organs to exercise public power phenomenon more and more common,also gradually become the focus of dispute,the people mouth along with the production of a series of legal problems,and in the current system of administrative law for this legislation there are some blank,led to the deficiencies of the administrative entrustment.This paper uses the methods of literature research,empirical analysis and normative research to discuss the legal responsibility of the entrusted organization from three aspects.The first part discusses the legal responsibility of the entrusted organization in our country’s administrative entrustment,specifically including the meaning and theoretical basis of the legal responsibility of the entrusted organization,the basic classification in the practice of administrative entrustment and the manifestation of administrative entrustment in the current legal system of our country.The second part discusses the problems existing in the legal responsibility of the entrusted organization in the administrative entrustment of our country.The legal responsibility of the entrusted organization and the qualification recognition of the entrusted organization are partly in the state of ambiguity in the legislation.Secondly,in the process of law enforcement,the entrusted organizations have different powers and responsibilities or abuse of power due to the inadequacy of the entrusted procedures.Finally,the lack of supervision standards of entrusted organizations leads to the lack of effective supervision of entrusted organizations within administrative organs and power organs.From three levels of legislation,law enforcement and supervision,the legal responsibility of the entrusted organization is analyzed.The third part puts forward a series of assumptions aiming at the deficiencies of the entrusted organizations in the second part.From the legislative level,the qualification requirements of the entrusted organization and how to determine the commitment of legal responsibilities after performing administrative affairs are elaborated respectively.Then,the procedure design is carried out for several symbolic problems in the enforcement process of the entrusted organization,and the targeted solution strategies or legislative improvement schemes are put forward.Finally,respectively from the authority and administrative authority within the supervision of the entrusted organization essence effectively put forward ideas to improve the administrative efficiency,accord with the basic principles of effective administrative and truly do responsible government,service government,sunshine government through transparent entrusted by the administrative main body,and then achieve the overall goal of promoting the rule of law.
