Research On The Perfection Of China’s Notarization Case Guidance System

China’s notarization system is based on political and economic life.After getting rid of the malpractice of administration,the notary function and legal effect are playing an increasingly important role in the social rule of law.At the national level,the notarization function can escort social and economic circulation and legal security;at the individual level,the notarization function can provide neutral,fair and reliable legal services,and is an important credit protection mechanism.The development of the notarization industry in my country has been relatively late and short,and related laws and regulations are lacking.Therefore,there is a certain degree of disorder in practice,which has seriously affected the image of the country’s rule of law.Therefore,it is necessary to provide a unified standard and guidance for notarization practice at a higher level,and the use of guiding cases is not only more flexible and faster than legislation,but also more conducive to the self-improvement of the notarization industry.Based on the published notarization guiding case,the article studies its current appearance,and discusses the necessity of perfecting the case guidance system from a legal perspective.And combined with reality,interpret the obstacles of the current case guidance system in the field of notarization,thereby forming a clear understanding,and then exploring the perfection of the basic framework of the system.This article has four parts excluding the introduction.The first part is the necessity of perfecting the notarization case guidance system.The article combines the current judicial reform status and the state of notarization,mainly from the perspective of strengthening the credibility of notarization,realizing the notarization function,and developing notarization in the new era,to explore the necessity of perfecting the notarization case guidance system.The second part is the investigation of notarization guiding cases.First,the article analyzes the notary guiding cases,systematic interpretation of existing cases release mechanism,structure,and operation of recognition.Secondly,compare the notarization guiding case with other guiding cases,take the relevant mechanism,purpose and actual effect of the case as the starting point,and compare it with the judicial expertise guiding case,the lawyer’s public legal service guiding case,and the administrative law enforcement guiding case.It is necessary to fully interpret the appearance of the existing notarization guiding cases.The third part is the interpretation of the plight of the notary Case Guidance System in China.The article combs through three levels of notarization guiding case,case guidance system and notarization system,discusses the specific dilemma of perfecting the case system,and forms a clear understanding of it.The fourth part is the perfect way of related systems.The article analyzes the selection mechanism,restriction mechanism,case update and withdrawal mechanism,etc.,and explores ways to improve the notarization case guidance system.The article plans the case guidance work from the aspects of clarifying the selection of case standards,standardizing the style of case writing,improving the case release procedures,and setting up restraining institutions,and promotes the improvement of the notarization case guidance system framework.
