With the development of science and economy,telework is becoming a new mode of flexible employment.Different from traditional employment,employees perform mental work by Internet technology in non-business places of the enterprise and choose his own work place and working hours as they like.Therefore,telework has many advantages.On one hand,employers can reduce labor costs because they do not need to provide employees with a working place.At the same time,employees can also avoid wasting time caused by traffic jam on the way to work,which improves work efficiency as a whole.And it has certain progressive significance.in line with contemporary advocates of the concept of green employment in response to the call of socialist economic development.On the other hand,telework avoids the aggregation of a large number of employees so that it is an important way for major public health and safety incidents.Especially,when the heart-coronary pneumonia epidemic comes,many companies choose telework to resume production and operation,which promotes the popularization and development of telework.This paper pays attention to the protection of labor rights and interests in telework.Starting from the overview of labor rights protection in telework,it synthesizes the definitions by domestic scholars and foreign ILO,EU,Japan,and the United States.And it introduces basic concepts which includes three elements: staying away from the employer`s business premises,using Internet technology and normalization.Besides,it analyzes the characteristics of telework: the freedom of the workplace,the flexibility of working hours and the electronic way of work channels.At the same time,it summarizes the types of telework from the perspective of the workplace.It finds out the necessity of protecting the rights and interests of teleworkers on the basis of concepts,characteristics and types,then lays the foundation for the following research.Using comparative research methods,it analyzes the relevant regulations of telework by foreign subjects such as the ILO,EU,Japan and the United States.Then make an evaluation,summarize their system advantages from perspectives of workers` legal status,right to rest,information security,privacy protection and right to health.Then use it as a reference to combine with my country`s practice.There are some problems such as labor relationship identification,working hours system,risk injury identification system,and protection of workers’ privacy rights.Finally,it throws out some suggestions towards these problems.Determine most of the teleworking labor relationship attributes.Formulate a targeted working hour system from routine daily work and overtime.Determine the time from work injury,Improve the risk and injury identification system from working time,workplaces and occupational disease.And protect the privacy of workers from their personal information and family privacy,which can promoting the economic development and ensure the harmonious and stable society.
