Research On Forest Restorative Justice Protection Mechanism

The juridical protection mechanism of forest restoration mainly lies in the management of the results of forest damage.At the same time,the mechanism emphasizes the effective restoration and management of the victims and the damage results of forest resources,so as to realize the rational utilization of forest resources and punish the illegal acts of destroying trees.In forest restorative justice protection mechanism in our country,by analyzing the relevant countries in ecological environment and forest resources management has made remarkable achievements.This paper found that some legal systems in China’s forest resources restoration management can not be fully applicable,but still have guidance and reference value.This paper is divided into five chapters:Chapter one mainly introduces the background,purpose and significance of the study on the judicial protection mechanism of forest restoration.At present,the theoretical and practical results of the judicial research on forest restoration at home and abroad,as well as the research methods of the judicial research on forest restoration in this paper.The second chapter focuses on the background,conceptual connotation,conceptual basis and specific content of the forest-related restorative judicial protection mechanism.The third chapter analyzes the current situation and predicament of the judicial protection mechanism of forest restoration in China from the aspects of legislation,judicature and law enforcement,including:the legislation has not yet formed a system,the scope of judicial review is narrow,and the supervision of law enforcement is insufficient.The fourth chapter selected several representative developed countries,such as the United States,Germany,Australia,Russia and so on,respectively to sort out and study the judicial protection mechanism of forest restoration,and obtained the enlightenment of foreign advanced experience to China’s forest restoration management,such as improving the legal system;Establishing the expert system;Formulate reclamation plans;A series of enlightenment,such as promoting public participation,has a positive reference significance for China’s forest restoration management.The fifth chapter is the perfection of the judicial protection mechanism of forest restoration in China,which mainly includes:expanding the applicable scope of the subject of forest restoration;Add forest restoration object application fields;Forest restoration content of applicable rules;Regularize the application procedure of forest restoration justice,and establish the comprehensive operation mode of forest restoration justice.Introducing a professional evaluation mechanism for forest damage identification results;Constructing the scientific restoration system of forest resource expert management;Unify the management system for forest restoration funds.
