Research On Patent Licensing Mechanism In Opening Standard-Setting Right

The core idea of supply side structural reform is to break through the existing contradiction of innovation supply by strengthening the innovation structural reform at the supply level,so as to solve the current situation of insufficient high-end supply and excessive low-end supply in the market.The design of innovation supply structure is inseparable from the effective support of intellectual property rights.Patents and standards are the key to the development of knowledge economy,and its innovation orientation is more and more prominent in the market economy structure in the period of economic transformation.Therefore,the research on standard setting and patent licensing under the new reform situation is the basic link of intellectual property design under the innovative structure,which has certain theoretical value and practical significance.The main purpose of the research is to explore the patent licensing mechanism in opening standard-setting right through the research on the standardsetting right and patent licensing.Firstly,it analyzes the necessity and effectiveness of the open standard-setting right,divides the open standard-setting right into three stages: the early stage,the transition stage and the late stage,among which the transition stage is divided into the inward opening stage and the outward opening stage,analyzes the three stages of the right opening by using the actor network theory,and obtains the evolution path of actors in different stages;Based on the theoretical analysis of the two-stage rights transition in the open transition period,a collaborative network model is constructed.Secondly,research on the influencing factors of patent licensing in open standardsetting right,select research methods of grounded theory according to research content characteristics,elaborate the concept and research process of grounded theory,and carry out grounded design of patent licensing research combining with analysis content;according to data,use grounded theory to carry out selective coding,spindle coding and core coding Level code,we can get the influencing factors of patent licensing behavior in four open standard-setting rights: market licensing demand,patent management platform,patent licensing channel and environmental factors,and establish the influencing factor model.Finally,the empirical test and case study are carried out on the analysis results of grounded theory.The influencing factors obtained from grounded analysis are transformed into variables,21 hypotheses of 4 dimensions are established,and the path of influencing factors is tested through the confirmatory path analysis of structural equation model,and the empirical model of patent licensing path in the right of opening standard setting is obtained;through the open innovation of Haier hope The analysis of intellectual property and standardization strategy of the new platform case further proves the research results of grounded theory in the main category analysis.Through the study of patent licensing mechanism in opening standard-setting right,this paper explores the path impact of open mode on patent licensing,and realizes the combination of qualitative and quantitative,objective and subjective in the research,and puts forward the shortcomings and future prospects in the research.
