Research On The Comparative Study Of Civil Litigation Mediation System In China And Laos

The Lao PDR is a socialist country,and its social system has much in common with China.Moreover,Laos is deeply influenced by Chinese Confucian culture and advocates peace as its priority.Therefore,the mediation system is very popular in Lao civil lawsuits.However,domestic and foreign research scholars have rarely studied the mediation system of Lao civil lawsuits.More research rooms are mainly aimed at the mediation system of the Anglo-American legal system represented by the United Kingdom and the United States and the civil law system represented by Germany and Japan.Mediation system,There is a lot of research on the mediation system of Chinese civil procedure,but there is little research on the mediation system of Laos civil procedure,and there is no precedent for the comparative study on the mediation system of Chinese and Laos civil procedure.The first chapter introduces the research methods and innovations of this article.The second chapter mainly gives a brief overview of the civil litigation mediation system.The third chapter mainly introduces China’s civil lawsuit mediation system and the development history and current situation of the mediation system in China.The fourth chapter is a systematic elaboration of the Lao civil mediation system.The fifth chapter mainly introduces the main components and procedures of the Lao civil litigation mediation system.The sixth chapter is the comparison and inspiration of the civil mediation systems of China and Laos.The purpose of this paper is to introduce the mediation system of the Lao people’s civil procedure systematically from the aspects of the development,formulation,constitution and settlement of the mediation system in the Lao PDR,so as to outline the basic outline of the mediation system of the Lao civil procedure.Through the comparison between the Chinese and Laos civil mediation system,we find out the shortcomings of the Laos mediation system,and make brief comments on the Laos civil litigation mediation system.The system of civil mediation is widely used in Laos.Compared with the development of China,the system of civil mediation in Laos still has many shortcomings,especially with the development of the economic process.Laos uses village-level mediation units,municipal mediation offices,and dispute resolution centers.It is becoming more and more difficult for the people’s courts at the four levels to reconcile themselves with a society characterized by global economic integration and industrialization.It is of great significance to the development of the Lao civil mediation system.If the Lao PDR can continuously improve its own civil mediation system so that it follows the development of the society,it will certainly bring about a positive impact on the political and economic development and social stability of the Lao PDR.
