On The Application Of Law In The Crime Of Sexual Assault On Minors

With the development of social civilization,more and more incidents of sexual assault on minors come into the public view,but the high rate of concealment is still an unavoidable problem.In the judicial practice,there are more and more questions about the judgment of crime and non crime,the judgment of this crime and the other crime,the dispute of the means and ways of the implementation of the criminal act,the problem of one-way protection of minors,etc.the gap of the protection of minors raises more and more questions.The protection of minors urgently needs to find the crux of justice and solve the judicial dilemma.This paper explores the legal application of the crime of sexual assault on minors from three parts:The first part is the basic overview of sexual assault on minors.This paper mainly discusses the legal connotation,characteristic analysis and the research of this paper to determine the scope of this study.The second part is to put forward the problems in the application of law.Starting from rape and indecency,this paper analyzes the problems existing in the application of law,discusses the distinction between this crime and that crime,the evolution of two-way protection into one-way protection,whether the same crime of compulsory indecency and indecency against children is an alien crime,the lack of protection of human rights of minors who have reached the age of 14,and the inability of minors under the age of criminal responsibility to commit indecency against children To commit a crime,etc.The third part is the path to improve the judicial application of sexual assault crimes against minors,in response to the problems raised in the second part,from the two aspects of the application of specific charges and the improvement of the judicial system,put forward countermeasures and suggestions to ease the dilemma of legal application.
