| With the rapid development of economy and society,the continuous improvement of people’s living standards,the use of motor vehicles increased dramatically,followed by the frequent occurrence of traffic accidents.At present,our country is facing a very serious situation of road traffic safety,the accident rate is increasing year by year,at the same time,the casualties and losses are increasing year by year.Traffic accidents not only bring all kinds of trauma to families,but also the injured and their families need to spend a lot of energy,material and financial resources to deal with the follow-up.Although China’s insurance system is constantly improving,due to the wide variety of insurance,it will also lead to the overlapping of insurance types and terms in practice,as well as the overlapping of multiple identities of the insurer in the same traffic accident,resulting in the situation of the coexistence of several insurances,so that the parties to traffic accidents can not get rapid claims in the post accident processing.The reason is that the compensation for traffic accidents involves not only the legal relationship of tort,but also the complicated legal relationship of insurance.The problem of insurance concurrence in traffic accidents not only exists in the scope of various commercial insurance,but also involves various social insurance.When the victims suffer personal injury traffic accidents on the way to work and meet the requirements of declaration of work-related injury,there is always a dispute on how to compete for compensation for personal injury and work-related injury insurance.Because of the blind area of the current legal system,it is urgent to find a clear answer to this frequent reality.At present,there is no accurate explanation of the concurrence in the legal system.The purpose of this paper is to explore effective legal approaches and solutions to protect the legitimate rights and interests of the victims,considering that the legitimate rights and interests of the victims can be effectively protected,and the compensation for the victims can not exceed the actual losses. |
