The Conflict Of Law Enforcement And Its Solution Of Police Station In The Period Of Social Transformation

In recent years,with the deepening of reform and opening up,China has entered a stage of rapid development.Various reforms have been in a critical period and a deep-water period.Social value judgment is diversified,and Social contradictions in all aspects are increasingly prominent.All of contradictions and interests are complex and changeable.In the process of cracking down on crimes and maintaining social stability,the police,due to subjective and objective factors,often encounter conflicts such as obstruction,resistance,attack and so on.The police’s personal safety and human dignity are damaged,the public credibility of law enforcement and legal dignity of the public security organs are challenged,and the final impact is the interests damage of the people and social stability.Through case study and questionnaire,this paper combs out the actual performance about the law enforcement conflict of police station,analyzes its causes,and puts forward corresponding countermeasures and suggestions,hoping to be beneficial to judicial practice.In the introduction part of this paper,the purpose of this study,the domestic and foreign related research review and research methods are briefly described.The first chapter introduces the performance of interest conflict in public security organs in the period of social transformation from the perspective of academic theory,and expounds the basic theory of law enforcement risk and law enforcement conflict of police station.The second chapter,taking X District of C as an example,lists six characteristics including high frequency of law enforcement conflicts and outstanding non violent conflicts in the form of questionnaires and practical cases,and analyzes five negative effects brought by conflict behaviors,such as weakening the credibility of law enforcement and the inability to protect the legitimate rights and interests of citizens.The third chapter explores and analyzes the causes of law enforcement conflicts from two perspectives inside and outside the public security organs.Internally speaking,the author believes that there are four major reasons: the lack of legal thinking of law enforcement subjects,the lack ofstandardization of law enforcement behaviors,the shortage of law enforcement resources and the generalization of police functions,and the legal loopholes and vague discretion standards.From the external analysis,the four aspects,namely,the difficulty of coordination of interest conflicts in the period of social transformation,the anomie behavior of Law enforcement counterpart,the low concept of law enforcement counterpart,and the insufficient optimization of public opinion space for law enforcement in the era of self media will also intensify the formation of law enforcement conflicts.In the last part of the paper,aiming at the above two reasons,the author puts forward seven measures,including changing the law enforcement concept,establishing and improving the internal law enforcement rules system of public security,building the risk conflict grade model of law enforcement,setting up the crime of attacking police with reference to foreign experience,guiding the expression of public demands to be rationalized and legalized,forming a normalized communication mechanism through the guidance of public opinion,and developing co-construction,co-governance and sharing governance Model in grass-roots area,to prevent and resolve law enforcement conflicts.The police is an important executor and maintainer of the national law.To respect the police law enforcement is to maintain the authority of the national law.
