| With the rapid development of the world today,China is already the second largest economy in the world,but with the continuous development of the economy,the living environment of human beings has also been gradually damaged.Since the18 th National Congress of the Communist Party of China,China has paid more and more attention to the construction of ecological civilization.The construction of ecological civilization has been the strategic position of the overall layout of the "five in one".In February 2017,"Several Opinions on Delineating and Strictly Observing the Red Line of Ecological Protection" was issued by the Central Office and the State Council,which proposed the delineation of the ecological red line and made a series of major decisions to deploy for ecological environmental protection and its ecology.Civilization building.In recent years,the central policy has become more and more perfect,which shows that the country attaches importance to the construction and protection of the ecological environment.There is no doubt that the country has promulgated several relevant laws and regulations on nature protection before and after the construction of the legal system on nature protection.This measure has made remarkable achievements in the construction and management of nature reserves in China.It is regrettable that the construction of the legal system related to nature reserves in China is relatively inadequate.The article takes the legislation of local protected areas as an entry point and introduces the Luobupo Wild Camel National Nature Reserve in Xinjiang as a case to discuss the existing problems in the legislation and practice of natural reserves.Xinjiang,as a national border area,is rich in wild animal resources,and wild camels are rare and endangered animals.This article mainly discusses the legislative research of the Xinjiang Luobupo Wild Camel National Nature Reserve,and combines it with practice to empirically verify the Luobupo Nature Reserve Research and analysis.At the same time,compared with other northwestern provinces and cities that selected Gansu Province,Ningxia Hui Autonomous Region,and Qinghai Province nature reserves for legal construction and legislative status analysis,in order to sort out the legislation of the nature reserve in Xinjiang Uygur Autonomous Region,combined with the selected Xinjiang Luobupo wild camels Nature reserves,identify legislative and practical issues in nature reserves,and propose solutions with feasible measures.The article is mainly divided into four parts.First of all,it introduces the overview of China’s nature reserves,including the classification,level,quantity,etc.of the nature reserves,combs and analyzes the nature reserves of the whole country,and at the same time,it also analyzes Xinjiang’s overall nature reserves and Xinjiang Luobupo Wild Camel National Nature Reserve.The general situation of the district is elaborated to understand the ecological status of the protected area;secondly,the legislative status of the national nature reserve is sorted out based on different basis,and the three provinces that are close to Xinjiang,such as Gansu Province,Ningxia Hui Autonomous Region,and Qinghai Province,are compared and analyzed the legislation of nature reserves in China,which expounds and analyzes the legislation status and legal basis of Xinjiang nature reserves.Thirdly,it focuses on the analysis of the first two parts to find out the problems in the legislation and practice of nature reserves.Finally,from the establishment of special laws,the establishment of local laws and regulations and other aspects proposes targeted legislative and practical solutions. |
