| Online shopping has become an indispensable part of today’s society.While online shopping brings us convenience,it also faces many challenges and violations.The universality of online shopping is not relative to the degree of protection for consumers.While enjoying the convenience of online shopping,people are also facing the threat of infringement of their rights.Most Chinese people have a indifferent attitude towards tort,and often think that it is a waste of energy to protect rights for petty profit.However,this kind of general cognition promotes the expansion speed of tort and is not conducive to the realization and development of legal system.Punitive compensation,as a form of liability in economic law,has a deterrent and punitive effect on operating producers.It is committed to protecting the legitimate rights of consumers and preventing similar violations from happening again.The punitive compensation system is also applicable in the field of online shopping.On August 1,2019,the general office of the State Council issued the guidance on promoting the healthy development of platform economy norms,which reflects the deepening attention of the state to the development of network platform.The document provides macro guidance on all aspects of promoting the economic development of Internet platforms.However,the specific ways to improve punitive damages are not specified in detail.In this paper,in addition to the discussion of punitive compensation system,it also discusses how to improve the punitive compensation system in the field of online shopping.In this paper,the first chapter analyzes the punitive compensation system of online shopping platform and the characteristics of online shopping.The second chapter is about the current situation and problems of punitive compensation in online shopping.It not only analyzes the current situation of the legislation of punitive compensation in online shopping,the current situation of the use of punitive compensation by consumers in online shopping,the current situation of the dispute resolution mechanism of applying punitive compensation in online shopping,but also discusses the existing problems in the above three aspects.The third chapter is the improvement of the punitive compensation system in online shopping,first of all,based on the improvement of the relevant legislation of punitive compensation in online shopping;secondly,through the way of increasing the responsibility of online shopping platform,improving the litigation procedures,and eliminating the establishment of punitive compensation insurance,the relevant supporting measures of punitive compensation system are improved;finally,explore the construction of multiple dispute resolution mechanism,in order to more comprehensively protect consumption Theright to claim punitive damages. |
