| At the same time as the continuous development and widespread application of Internet technology,the Internet has gradually penetrated into every area of people’s lives.With the rapid development of the Internet economy,new types of unfair competition in the Internet field are also increasing.Compared with the traditional product market,the market structure and competition model in the network field are significantly different,and there are many characteristics of the unfair behavior.Regarding the traffic hijacking behavior of Internet operators,whether in terms of behavior composition or implementation mechanism,this new type of unfair competition behavior is quite different from the previous unfair competition behavior.This article focuses on the legal issues related to the protection of consumer rights in new types of unfair competition on the Internet,represented by traffic hijacking by Internet operators.Taking the guidance case No.45 issued by the Supreme People’s Court as an entry point,this paper analyzes the new types of unfair competition in the Internet The conceptual characteristics of behavior;then,to elaborate on the issues related to consumer rights in China’s new network of unfair competition;next,in-depth discussion and analysis of the important legal system of China’s new network of unfair competition and its protection of Internet consumers’ rights and interests Deficiency,the research perspective of this article is positioned at the legislative level to protect the rights and interests of Internet consumers.Finally,starting with the protection goals of consumers’ overall interests and long-term interests in the new unfair competition in the Internet,the relevant legislative improvement suggestions are proposed as follows: First,reconstruct the concept of consumers in the Internet environment;Second,improve important legal systems: In the current "Anti-Unfair Competition Law" provides consumers with the right to sue;in the "Consumer Rights Protection Law" to establish the system of group litigation rights;at the same time to sort out the relevant provisions of the "E-commerce Law";third,strengthen the important legal system Collaborative protection. |
