Housing is an important issue of people’s livelihood.It is very important for China’s economy to develop smoothly and healthily,and for the people to live and work in peace and contentment.The concept of public rental housing was first put forward in 2010.As a social assistance and social welfare policy,public rental housing is one of the key housing security systems in China,and it is also one of the measures to solve the housing problem in China.In 1998,the original plan of our country was to establish a housing security system based on affordable housing,and to carry out commercialization and marketization of housing at the same time.After 2003,more and more rural workers turned to urban development,and the housing problems of these migrant workers quickly highlighted.In response to the social change,the government proposed measures to develop public rental housing and set the goal of "living in a home" to strengthen housing security.In 2012,China’s Ministry of Housing and Construction issued the "Public Rental Housing Management Measures ",and then through normative documents to guide the establishment of public rental housing related supporting mechanisms.The support of the law is a guarantee for the long-term development of the system,and the establishment of a perfect legal system of public rental housing will make the construction and management of public rental housing more efficient and fair.To speed up the legal construction of public rental housing,we should not only take various measures in practice to push forward,constantly sum up and improve measures,but also think in theory,find problems,and solve them in time.The main text is divided into four parts:The first part is to introduce the general principle of public rental housing,first of all,to distinguish the concept of different public rental housing regulations,to distinguish public rental housing from low-rent housing,affordable housing,and then to analyze the characteristics of public rental housing.In the end,the theoretical basis and practical direction of public rental housing in China are discussed.The second part is from the public rental housing system operation of the general legal system norms and public rental housing practice to find the existence of related problems.The third part is through the analysis related representative country public housing legal system design research,summarizes draws lessons from its public housing legal system development successful experience.The fourth part of the development of public rental housing and foreign experience to promote the formulation of China’s housing security regulations,and from the public rental housing investment mechanism,applications for review and waiting for the allocation ofprocedures,supervision and management mechanism and exit mechanism and other aspects of China’s public rental housing legislation,with a view to constantly improve the legal system of public rental housing. |
