Research On Legal Issues Of Family Trust Registration

With the rapid development of China’s economy in recent years,the number of high net worth people has gradually increased,the way of managing family wealth has also shown a diversified development,and the number of people who choose the family trust model has also increased.Family trust is a special trust model,which plays an important role in the inheritance and management of family wealth.However,the regulation of family trust in China’s trust law is not perfect,especially the registration system of family trust,which is an important part of family trust,has obvious defects.As a result,many high net worth families who choose this mode "have no way to start",making it difficult for family trust to develop healthily in China.This paper discusses the problems and shortcomings of the family trust registration system and puts forward some suggestions.This paper is divided into four parts:The first part mainly introduces the family trust system from the origin and development of family trust and its legal relationship.Second part for this family trust registration system in our country at present the plight of the,emphatically from the object of family trust registration requirements,the specific procedures and registration from several aspects,such as legal effect,the author analyzes the reasons of family trust registration legislation to difficulties encountered,and then points out that our country present legislation for family trust registration loopholes and deficiencies of legal regulation.The third part is the overseas investigation and evaluation of the family trust registration system.This part mainly counts the provisions of family trust registration system outside the region and in Hong Kong and Taiwan of China,and enumerates the typical institutional arrangements,summarizes the useful experience,and demonstrates its feasibility and feasibility.The fourth part,combined with the actual situation of our country,mainly analyzes the solution path of the legal dilemma of family trust registration.Starting from the aspects of legislation and supporting system,it analyzes the feasibility of the construction of family trust registration system and puts forward reasonable suggestions,so as to enrich the theory and promote the development of trust industry.
