Research On Competitive Neutrality Of Government Behavior In The Context Of Optimizing Business Environment

At present,Good business environment has become a strong competitiveness,which is not only a strong support for a country to participate in international economic competition,but also an effective engine for the country to enhance market vitality and promote fair competition.China’s economy is shifting from a stage of rapid growth to a stage of high-quality development.We are at a crucial stage of optimizing the economic structure and driving forces.It is urgent to optimize the business environment.Maintaining fair market competition is an inevitable requirement to optimize the business environment.The formation of a fair competition market order requires not only the orderly participation of market players,but also the strong promotion of the government.Therefore,the key to optimize the business environment is to reduce the damage caused by the government’s intervention in the economy.The competition-neutral system,which originated in the reform of the Australian domestic economic system,advocates that the government treats enterprises of different ownerships equally and creates a public atmosphere of free and fair market competition,which coincides with China’s current goal of building a unified,open,and orderly market environment.Therefore,the introduction of a competitive neutrality system to restrain government behavior,so that when the government intervenes in the market to remain neutral,it has Age requirements.By sorting out the development and evolution of competitive neutrality in Australia and Europe and America,the connotation and behavior requirements of competitive neutrality are defined,and the application of competitive neutrality is defined based on the development status of China.In order to optimize the business environment and build a fair competition market system,it is proposed to introduce competition neutrality with a view to regulating government behavior and extend the scope of application to all market players participating in the competition,whether state-owned or private,domestic or foreign,large or small.In terms of behavior,the government is required to maintain neutrality in taxation,supervision,government procurement and other aspects,and no enterprise shall enjoy a competitive advantage due to the improper favoritism of the government.In fact,the reform measures in many fields in China coincide with the core concept of the competitive neutrality.For example,the reform of state-owned enterprises that hasbeen carried out for decades,including the separation of ownership and management rights,the reform of classified supervision and corporate governance,are in line with them.Competitive neutrality requires weakening the relationship between the government and state-owned enterprises,separation of commercial and non-commercial activities,and regulatory neutrality.The establishment and operation of the Shanghai Free Trade Zone is a more visible manifestation of the competitive neutrality.The programmatic document-"China(Shanghai)The provisions of the Free Trade Pilot Zone Regulations on the fair competition of all market entities in the zone,the negative list system,and the innovation of government supervision models all perfectly interpret the competitive neutrality.In addition,in recent years,in order to create a good business environment,the government has introduced many policies and measures that reflect competition neutrality.For example,the "Central Committee of the Communist Party of China and the State Council on Building a Better Development Environment to Support Private Enterprises" was launched on December 4,2019.Opinions on Reform and Development,and the Regulations on Optimizing the Business Environment,which were implemented on January 1,2020,can effectively restrain the government’s improper intervention in the economy and create a fair market atmosphere for all types of enterprises.Of course,it is undeniable that despite a series of reforms in recent years,they have achieved great results.in reality there are various forms of deviation from the neutrality of competition in both government participation and regulation and regulation.For example,discriminatory treatment in government procurement,shady operation in PPP projects,differentiated market access rules,discriminatory loan financing conditions,preferential tax incentives and government subsidies,these non-neutral government actions undermine the market order of fair competition and are not conducive to the establishment of a market-oriented business environment.The reasons are that the government has not clarified its own power boundary,the imperfect fair competition review system,and the inadequate regulation of the administrative monopoly by the Anti-Monopoly Law.In order to create a business environment based on the rule of law,and to effectively promote the neutrality of government behavior,we must first implement the fundamental status of competition policy and require the government to interfere with the market with a humble attitude.Second,we should anti-legalize the fair competition review system,and As a basic standard for review,competition neutralityestablishes a review process of "self-examination + external control" to realize the anti-monopoly law enforcement agency’s right to advocate for policy-making.Finally,it is necessary to seize the opportunity to amend the Anti-Monopoly Law and modify it.Regarding the provisions of administrative monopoly,expand the scope of regulation,clarify the responsibilities of various subjects,increase the deterrent power of law enforcement,so as to better regulate the government’s behavior that disrupts competition and promote the orderly formation of a fair competition market.
