Research On Limited Legal Personality Of Intelligent Robots

As a new technological science,intelligent robots are the most representative products of artificial intelligence technology.They have also brought many realistic challenges while changing human life.Whether in the field of copyright or medical infringement,there is an essential question,namely whether intelligent robots should enjoy legal personality.Therefore,we need to discuss the legal personality of intelligent robots in theory.This article is divided into five chapters.The first chapter is the theoretical definition of legal personality of intelligent robots.First,it briefly explains the types and functional characteristics of intelligent robots,and lays the theoretical foundation for the discussion of the limited legal personality of intelligent intelligent robots.Second,it sorts out the history of legal personality from two paths of rationalism and humanism,and reflects on the defects of traditional legal personality.By elaborating and analyzing the object theory and the complete subject theory of intelligent robots,the core viewpoint of this article is the limited legal personality theory of intelligent robots.The second chapter is the legal problems and analysis caused by intelligent robots.Firstly,the legal problems caused by intelligent robots are explained.At present,there are many legal problems caused by intelligent robots.The specific manifestations are the fuzzy identification of intelligent products and ownership,the unknown positioning of intelligent driving systems,and the imbalance of intelligent medical responsibilities.The analysis of the reasons is specifically the absence of existing laws,lack of ethical norms,and lack of regulatory systems.The third chapter is the necessity of giving limited legal personality to intelligent robots.The necessity is mainly discussed from the perspectives of law and society.From the perspective of resolving legal disputes,the limited legal personality of intelligent robots can clarify the work and copyright ownership of intelligent robots,clearly identify the driver status of intelligent systems,and balance the responsibilities caused by intelligent diagnosis and treatment.From the perspective of meeting social needs Given the limited legal personality of intelligent robots,it can realize the positive guidance of society,reduce the economic transaction costs of intelligent industries,protect human rights,and realize the harmonious development of humans and intelligent robots.The fourth chapter is the construction of the limited legal personality of intelligent robots.The first is to elaborate the current status and enlightenment of extraterritorial legislation of the legal personality of intelligent robots.The second is to discuss the limitation of the legal personality of intelligent robots from a legislative perspective,and to define the attributes of legal personality of intelligent robots.The attributes,scope,and starting point of the ability are limited to prevent the expansion of the intelligent robot’s rights and capabilities;then it is proposed to strengthen the intelligent robot ethics and improve the intelligent robot supervision system;finally,the intelligent robot responsibility system is established from the perspective of determining dual subjects and setting up compulsory insurance and compensation funds.
