On The System Of Visitation Right In China

China’s rapid economic development is in line with the world.The rich and colorful life leads to a high divorce rate.After divorce,it often leads to property disputes,child custody disputes,and visitation disputes.After divorce,it is bound to bring different degrees of harm to the minor children.Children are limited in economy,and children are also hurt in family relations.The visitation system is positive It is to build a bridge between the visitors and the visited to comfort the spiritual injury,but in the judicial practice,the system of visitation right is not enough.In the judicial practice,the handling of specific problems can not be perfectly solved,and the situation and law can not win-win.In order to successfully solve all kinds of legal problems encountered in life,we must find out the crux of the problem,learn from other countries’ better legal views,combine the characteristics of our legal system,and improve the system of visitation right on the basis of our national conditions.This paper first summarizes the right of visitation,analyzes the meaning of the system of the right of visitation,summarizes the characteristics of the right of visitation,and analyzes the nature of the right of visitation and the value of the system of the right of visitation.However,there are still some deficiencies in the system of visitation right in our country,such as the narrow scope of the subject of visitation right,the insufficient consideration of children’s interests,the difficulty in the implementation of visitation right,the lack of effective supervision in the exercise of visitation right,and the lack of operability in the content of visitation right.However,in some countries of common law system and continental law system,there are unique provisions on visitation right system.I have passed the Through the analysis of the legislative provisions,this paper identifies the relevant laws and regulations applicable to China’s social conditions,and analyzes the current situation of China’s visitation right legislation,and then puts forward some perfect suggestions: establishing the principle of maximizing the interests of children,expanding the scope of the subject of visitation right,expanding the rights and obligations of visitation right,ensuring the implementation of visitation right,and clarifying the content of the suspension of visitation right.The perfection of the visiting system can ensure that the minor children get more love,and then reduce the crime rate of the divorced family children,indirectly alleviate the tension between the society and people,and promote the harmonious and stable development of the society.
