Study On Protection Of Same-Sex Couples’ Rights

With the progress and development of society and the advent of the Internet Information Age,the topic of homosexuality has no longer made people turn Pale.So far,thirty-one countries,including the United States,Canada,Germany and Taiwan,have successfully legalized same sex marriage in different forms.Especially in May 2019,after Taiwan officially legalized same-sex marriage,homosexuality aroused heated public debate in China.On an online social media platform,the topic "opinions suggest that same-sex marriage be legalized in the civil code" has been read 830 million times and discussed 284,000 times,but a large part of it is discriminatory,our country is far from being open and inclusive enough to embrace homosexuality and even legalize gay marriage.Therefore,in China’s existing social environment,the legalization of same-sex marriage can not be accomplished overnight.Although the legalization of same-sex marriage can be ignored in the current situation of our country,the protection of the rights and interests of same-sex couples needs to be solved.According to statistics,China’s Gay community has more than seventy million people,accounting for about 5% of the country’s total population.The number of this group has been too large to ignore,however,China’s current law for the same-sex couples this group did not mention,its rights and interests protection is greatly lacking.Not long ago,a teacher because of homosexual identity disclosure and forced to leave the case of the occurrence of our law has entered the inevitable face of this issue.Under this background,this article will carry on the thorough system research to the same-sex partner’s rights protection question.At the beginning of the topic selection,I noticed that many scholars in our country have done a lot of research on this topic,but most of the scholars intend to focus on the issue of same-sex marriage legalization,in view of the current situation in China,it is too early to discuss whether same-sex unions should be included in the legislation.Therefore,based on China’s current national conditions,through the analysis of the development of China’s same-sex partners,learn from the foreign countries’ legislative practice on the protection of the rights and interests of same-sex partners,combined with China’s existing laws,to explore the rights and interests of same-sex couples to protect the system.
