The Dilemma And Solution Of The Convergence Of Market Supervision Organizations

Administrative organizations serve their administrative tasks,which to a certain extent determine the organization’s existence,size and structure.The organization’s functional allocation should objectively contribute to the performance of tasks and the achievement of goals.The reform of market supervision institutions is a comprehensive law enforcement system reform that scientifically sets up institutions,optimizes administrative functions and makes power operation coordinated and efficient.It is a division of labor restructuring and coordination of the three dimensions of "administrative power,decision-making management power and comprehensive law enforcement power".In essence,the adjustment and change of the administrative power is the different cognition to the vertical allocation of the market supervision administrative power.Decision-making management is the reconstruction of division of labor,forming various comprehensive law enforcement systems.The organizational dilemma of "physical integration" and "chemical integration" is the primary problem in the construction of market supervision system.To solve this problem,the principles and tasks of institutional integration need to be clarified.Based on the investigation of the reform of grassroots market supervision institutions,it is found that there are some problems in organizational integration,such as the lack of uniform standards for law enforcement,different organizational cultures,confusion in law enforcement mode,the "comprehensive but not specialized" supervision team,and prominent localized management.The essence of comprehensive law enforcement power is to delimit jurisdiction.The core task of organizational integration is to solve the horizontal and vertical coordination,external and internal coordination brought about by "fragmented supervision".This explanation can respond to the integration dilemma faced by market regulators and can also guide the restructuring of market regulators.It is suggested to adopt measures such as unified legal standards,collaborative organizational culture,creating a "grid" supervision team,innovating joint supervision mode,exploring cross-regional supervision mechanism and so on,in order to reconstruct and optimize a coordinated and efficient comprehensive supervision system.Theoretically speaking,China should implement unified supervision and management standards and establish a unified supervision organization.However,the basic attributes and internal logic of different powers are not the same,and "applying mechanically" will bring negative effects instead.Based on the optimization of functions with different attributes of administrative power,food safety and quality supervision can be managed locally in the future.However,the market supervision for industry and commerce tends to be highly administrative.The implementation of territorial management is feasible in theory but does not match the requirements of unified market in essence.Vertical management should be implemented.
