Legal Research On The Motor Vehicle No-Fault Compulsory Insurance System

The quantity of automobile insurance is increasing with the rapid development of automobile industry.Motor vehicle traffic accidents are more and more common in our daily life.Therefore,the problem of responsibility attribution and victim relief has become the focus of people’s attention.According to the discussion of the compulsory liability insurance system of motor vehicles in China,and referring to the relevant provisions of the compulsory liability insurance system without fault in Taiwan,Japan,the United States,Germany and other countries,the unique advantages of the compulsory liability insurance system without fault of motor vehicles are analyzed.The main advantages are that its insurance adopts the principle of no fault liability in the principle of liability fixation,its insurance pays more attention to the protection of the interests of the victims in the purpose of legislation,and its insurance can make the victims get timely and effective relief in the aspect of specific compensation.These unique advantages also bring new inspiration for the improvement of China’s automobile compulsory liability insurance system.There are some problems in the compulsory liability insurance system of motor vehicles in our country,such as the insufficient scope of protection for the victims,the excessive limit of compensation,the difficulty for the victims to obtain timely compensation,and the imperfection of the social assistance fund system for road traffic accidents.These problems can be effectively solved by studying the relevant provisions of the compulsory liability insurance system of motor vehicles without fault in domestic and foreign areas.The main purpose of this research is mainly about the study of the automobile no fault compulsory insurance system,and to build a more perfect automobile compulsory liability insurance system in China through absorbing the advantages of the automobile no fault compulsory insurance system.
