On The Supervision Initiation Mechanism In China

Since the 19 th national congress of the communist party of China enacted and passed the supervision law of the People’s Republic of China,China has formed a supervision legal system with it as the core.Since then,under the leadership of the CPC central committee,the supervision and reform work has been carried out in an orderly manner,and remarkable achievements have been made in the supervision and reform.The starting mechanism of supervision is a working mechanism in which the supervisory organs accept,investigate and deal with the clues of the problems before filing the case according to the law,and various departments coordinate and restrict each other in the process.As the initial stage of supervision activities,the supervision starting stage is an important part of supervision work in China.This paper summarizes the establishment and development of the supervision system after the founding of new China,as well as the establishment and changes of the supervision initiation procedure.The basic contents of the current mode of supervision initiation mechanism in China are carefully summarized and analyzed.Based on the relevant legal basis of supervision initiation and combined with party discipline and regulations,the general framework of supervision initiation mechanism in China is presented,namely,the acquisition and disposal of problem clues in the supervision initiation stage.In addition,the scope is broadened and compared with the supervision initiation mechanism of countries outside the region such as Sweden,Denmark and the European Union.In combination with the characteristics of supervision initiation mechanism of various countries,it is demonstrated that China’s supervision initiation has also established the principle of relieving distress,the principle of combining active and passive,and the principle of proportion.Further clear the supervision of the start up conditions,namely monitoring start up,should be to monitor can clue and credible,can check facts as the prerequisite,clarify the supervision start the program,the problem and clues of access,including the problem after review and disposition of clues,and may enter the preliminary verification procedure,and combining with the supervision of the supervisory start,including the internal supervision and external supervision and so on to detailed analysis and supervision start working mechanism,the general framework of mechanism of supervisory started in our country to supplement,which sums up the mechanism of supervision in our country start with closure and the characteristics of secret sex,investigative,affordable,The main framework of supervision initiation mechanism in China is fully displayed.However,due to the imperfect supervision legal system in China,there are still many problems in the supervision initiation mechanism.Starting from the concrete supervision work,it can focus on three aspects: the handling of the clue to the problem,the regulation of the primary nuclear system and the supervision of the supervision initiation.In view of the above problems existing in the supervision initiation mechanism in China,this paper combined with overseas experience and put forward corresponding Suggestions,including improving the information management of problem clues,building information data platform and improving the problem clues management mechanism.Standardize the handling of problem clues,improve the primary nuclear system,and clarify the relevant provisions on the primary nuclear procedure and evidence;Strengthen the supervision system,on the basis of strengthening the internal supervision and further play the role of external supervision,in order to be beneficial to the improvement of China’s supervision start-up mechanism.
