On The Change Of Marriage And Family Ethics From The Change Of Marriage Law(1950-2001)

Family is an important part of social constituent elements.The rational management of family ethics determines the important direction of its constituent subject.It is also the foundation of individual happiness in the constituent elements of family.Family ethics in the category of historical significance is a significant noun concept,in different times background,in a variety of factors have different attributes of the times,under the influence of the attributes of different times,the connotation and extension of the concept of marriage ethics is not the same.In class society,family ethics based on the influence of different class attributes also has different class attributes.The new family ethics concept is based on history and class attributes of the absorption,integration and give the characteristics of the times to develop,Family ethics is based on the development of social productive forces in its own time.It has certain social attributes,era attributes and independence.The family,as a collection of people,is an important stimulating factor of peoples social production environment,which plays an important role in peoples socialization.Traditional marriage and family ethics are denied,which makes many reasonable factors(such as filial piety)denied or belittled,making the modern family into a certain plight.This article takes the three Marriage Laws from 1950 to 2001 as the analysis material;From its vicissitude to observe the change of marriage and family ethics concept,this paper argues that there are still positive factors in the traditional marriage and family ethics concept that are conducive to the current marriage and family ethics construction.In addition to the introduction and conclusion,the article is divided into four parts:The first part defines the ethics of marriage and the ethics of marriage law.It discusses the following five aspects: equality between men and women,monogamy,freedom of marriage,protection of the vulnerable rights and interests of women,the elderly and children,and family planning.The second part is based on the provisions of the three Marriage Law and its judicial interpretation,From the equal rights of men and women,freedom of marriage,property ownership and the focus of each MarriageLaw amendment and other aspects of the Marriage Law changes in different periods are analyzed.The Marriage Law of 1950 is essentially a revolution about marriage and family system.Its main aim is to pursue equality between men and women and to realize freedom of marriage.At this time,the level of equality between men and women and freedom of marriage is still relatively low.The Marriage Act of 1980 is essentially depoliticized,In the political environment of bringing order out of chaos,the reconstruction of the family system during the socialist construction period was completed,ending the politicized era of marriage and family relations which lasted for 20 years,and spreading the freedom of marriage and the concept of equality between men and women again.The amendment to the Marriage Law in 2001 was a legal response to the reality and embodied the principle of human-orientation and the highest degree of equality between men and women and freedom of marriage.The third part summarizes the change of marriage and family ethics from four aspects:freedom of marriage,balance of property between husband and wife,promotion of women status and intergenerational relationship.The fourth part points out the predicament of the current marriage ethics and advocates the importance of family function,establish love-responsibility-equality family ethics relationship,establish the benchmark of intergenerational harmony,and find ways to improve the plight.
