On The Perfection Of The Right Relief System For Civil Servants In Administrative Law Enforcement

The protection of civil servants’ rights in administrative law enforcement category is relatively weak in our country,and it has always attached great importance to the fulfillment of civil servants’ obligations in administrative law enforcement category while neglecting the protection of their rights.Influenced by the administrative law of the continental law system countries,the civil servants in the administrative law enforcement category may be infringed by the internal administrative acts of the administrative organs in the administrative personnel management relations,or by the external administrative counterparts or others in the administrative law enforcement process.Since internal administrative acts are not regulated by the Administrative Procedure Law,judicial protection is excluded from the right relief system.External administrative law enforcement acts are mainly backed up by national power and regulated by administrative organs’ own administrative power and national penalty power,thus forming a relatively systematic protection system for the rights of law enforcement civil servants.However,from the characteristics of administrative law enforcement,there are still obvious deficiencies,such as imperfect relevant systems,weak pertinence and operability of relevant systems,etc.,which need to be further developed.Perfect.The inadequate protection of civil servants’ rights in administrative law enforcement is due to not only the influence of the idea of "official standard" and the current stage of development of the rule of law,but also the imperfect laws and regulations,and the imperfect relief procedures.It is an inevitable requirement of a society ruled by law to improve the system of safeguarding the rights of civil servants in the administrative law enforcement category and to pay attention to the legalization of the protection of the rights of civil servants in the administrative law enforcement category.It is suggested that the protection of the legal rights of civil servants in administrative law enforcement should be strengthened by updating the concept of rights protection,perfecting relevant laws and regulations,perfecting the administrative relief system,and strengthening the internal security relief system of administrative law enforcement organs.
