To further promote the reform of medical and health system,optimize the medical and healthcare system,transform government functions and achieve the general objective of price reduction in medical reform,our country has launched the reform of group purchasing organizations(GPO).In the GPO reform,our country first selected Shanghai and Shenzhen as the pilot cities,which have now achieved fairly good results with significantly lower drug purchasing prices.Although GPO was borrowed from western countries,the GPO operation model in China has been dominated by administrative power from the very beginning and has therefore inevitably faced with the excessive intervention of,and even monopoly of administrative power in its operation and implementation.In the pilot project,the building and operation of GPO have generated a series of conflicts with the anti-monopoly law.The administrative monopoly therein has hampered the efficiency of drug purchase,excluded and impeded the competition in the drug purchasing market and damaged the interests of end-consumers in the drug market.In this paper,the author summarized problems reflecting the administrative monopoly suspected to be existing in GPO building,trading,price fixing and other aspects including local protection,transaction object specifying and transaction price limiting,then concluded and studied the disputed problems above with the method of literature study,case study and comparative analysis.On such a basis,addressing the present GPO operation in our country,the author proposed four suggestions in this paper: firstly,allow the establishment of a GPO private platform to compete with the government-built platform.;secondly,introduce the fair competition review of GPO platform established by the government,avoiding the excessive intervention of administrative power by prior review;thirdly,publish the anti-monopoly guidelines for GPO trading to guide GPO’s purchasing behavior and improve the law-enforcement level of anti-monopoly department;fourthly,suppress the impulse of administrative power on the whole and perfect the legislation and law enforcement against administrative monopoly.
