Study On Administration Problems Of Public Lawyers In Tianjin City

The Fourth Plenary Session of the 18 th CPC Central Committee clearly pointed out that: “Party government organs and people’s organizations at all levels generally set up public lawyers.” In recent years,with the development of the socialist market economy and the acceleration of economic globalization,the tests faced by party and government organs at all levels in major administrative decisions and important administrative actions have become more and more severe.They need to deal with more and more complex legal matters.It is imperative to promote the construction of public service lawyer system.This paper uses the literature review method,comparative research method and questionnaire method.This paper first defines the concepts of lawyers,public lawyers,social lawyers,government legal consultants,government legal institutions,legal aid lawyers,etc.,systematically sorts out the government rational theory,the rule of law government theory,and the professional community theory.And it conducts an empirical analysis on the status quo of the management of public lawyers in Tianjin,especially management institutions and the team construction,and summarizes the problems existing in the management of public lawyers in Tianjin,and discusses the causes of the problems.Secondly,this paper analyzes the experience of the United Kingdom,the United States and other countries and the experience of Guangzhou,Xiamen,Yangzhou and other areas,sums up their experience and enlightenment.Finally,this paper proposes countermeasures to improve the management of public lawyers in Tianjin from the aspects of perfecting the legal and regulatory system for public lawyers,improving the guarantee mechanism for invigorating the vitality of public lawyers,innovating the management strategy of public lawyers,and promoting the joint management of public lawyers.
