Research On Legal Issues Of China’s Network Car Operation Supervision

As a typical representative of the "Internet +" economy,the network car has been in dispute since its inception.On the one hand,the production of the network car has indeed solved the pain problems of the society,such as “difficulty in taxiing” and“high cost of taxis”.On the other hand,due to the fact that the development of the network is still in its infancy,there are still many improper measures for its own and supporting regulatory measures.At the same time,some infringements and even criminal cases around the Internet have provoked the nerves of society.Undoubtedly,the generation of the network car is a huge improvement in the city taxi industry.The network car is also unknowingly forced the reform of the traditional taxi industry,injecting fresh blood into the city taxi industry.Due to the combination of online and offline online and offline,the traditional taxi supervision mode is not fully applicable to the network car.At present,there are many chaos in the network car,and market supervision is an important means to solve the chaos in the market.Therefore,how to conduct market supervision on the network car is a valuable research topic.This paper mainly discusses the legal issues of network car operation supervision from three parts.The first part is the theoretical analysis of the economic law of network car operation supervision.This part first clarifies and defines the concept of the network car,and on this basis analyzes the main characteristics of the network car.Secondly,from the perspective of market supervision law,it provides the theoretical basis of economic law for the supervision of online car.It mainly analyzes the necessity and feasibility of the supervision of the network car.The adjustment object and purpose of the economic law,the inherent defects of the market economy and the characteristics of the network car determine the necessity of supervising the network car;the system design of the market supervision law,the diversity of means and methods,the Internet supervision thinking and Technology makes it feasible to supervise the network car.The second part is the current legal status and problem analysis of China’s network car operation supervision,mainly from the network car operation supervision legislation,supervision status and existing network car market entry threshold is too high,consumer protection mechanism is lacking,operable The regulatory issues such as the lack of market exit mechanism are analyzed.The third part is to improve the legal advice for the operation of the network car,mainly for the second part of the problem content from the improvement of the network car market access system,the construction of consumer rights protection mechanism and the improvement of the network car market exit system,etc.In this regard,it proposes legal advice on the operation and supervision of the network.
