Research On The Legal Guarantee Of The Basic Party Construction In Foreign-funded Enterprises

At present,in the economic field,the party construction of state-owned enterprises has accumulated rich experience,and relevant policies are relatively complete.However,in the field of non-public enterprises,especially in foreign-funded enterprises,the party construction is still in the exploratory stage,which is the weak link for the party organization to carry out the party construction in the grass-roots units.Therefore,in order to achieve a comprehensive victory in Party building,we must go deep into the new field of grass-roots party building in foreign-funded enterprises.However,due to the differences in the national system and corporate culture,the relevant party construction work of foreign-funded enterprises cannot copy the experience of the party construction work of state-owned enterprises.Only after a large number of demonstration,practical experience summary and legislative improvement can the work be better carried out.First of all,this paper expounds the importance,necessity and legitimacy of the construction of the grass-roots party organizations in foreign-funded enterprises.On this basis,through the achievements of the party organization of Panasonic home appliances(China)Co.,Ltd.,The author analyzes relevant materials and concludes the conflicts between the laws,regulations,normative documents and the party rules,the application of policies,the rights conflicts between the Party committee and the board of directors,and the dual roles of the enterprise personnel Part of the role of conflict and other issues.In order to deal with the problems in the process of the development of the Party Construction in foreign-funded enterprises,the author puts forward different countermeasures from the three levels of constitution,basic law and articles of association.First of all,the political leadership of the grass-roots party organizations of foreignfunded enterprises is confirmed through the constitution.Secondly,the foreign-funded enterprises can stipulate various party construction activities and relevant supporting measures in the articles of association of the company that the party organizations try to carry out within the scope permitted by law.Through this method,they can continuously practice and find out a set of effective working methods,and then make use of the advantages of the policy to carry out nationwide pilot promotion with a full range of aspects.Finally,for the mature policy,it can be written into the company law through the way of policy legalization,so that it has legal effect.
