| The family is the foundation of society,and the stability of marriage has a huge effect on social stability.As the current divorce rate in China has increased year after year,social problems caused by divorce have also increased day by day,and the responsiveness of legislation has also increased.China ’s “Civil Code Marriage and Family(Draft)” added a system of divorce cooling-off period,adding a 30-day divorce cooling-off period to the registration divorce process,which means that there will be a 30-day period for the completion of the divorce process.Waiting time,the divorce process can be terminated at any time during the divorce cooling-off period,and the divorce can be cancelled.Only after the divorce cooling-off period can the divorce process be truly completed.This article puts forward a concrete constructive idea around the newly established divorce cooling-off period system in the Civil Code Marriage and Family Edition(Draft).By sorting out the development of the divorce system in China,further analyzing the significance of constructing a divorce cooling-off system,and by comparing and referring to the methods,it is proposed that China should absorb foreign experience in order to make reasonable suggestions for the setting of the divorce cooling-off period and point out that Three aspects are further improved: first,a further reasonable distinction can be made in the setting time;second,the application of the divorce cooling-off period should be distinguished to prevent the "one size fits all" setting;third,the correspondence with the setting of the divorce cooling-off period should be improved as soon as possible.supporting measures. |
