Reflections On The Administrative Law Of The Disclosure And Protection Of Personal Information Under The China’s Credit Investigation System

As the role of credit in social development has become increasingly prominent,China has also paid more and more attention to the construction of the credit system,so credit investigation has played a very important role at the moment,but disclosure and protection of personal information also have some problems to be solved under the credit investigation system in our country,so from the perspective of administrative law,the author uses comparative analysis,case analysis and other research methods to analyze and discuss related issues.This article first analyzes the concept of credit investigation and disclosure of personal information under the credit investigation system,and elaborates the relationship between the disclosure and protection of personal information.Secondly,the current situation of the disclosure and protection of personal information under the credit investigation system in China is described,and the problems of the disclosure and protection of personal information under the credit investigation system are analyzed separately.The problems in the disclosure of personal information are: first,the credit bureaus have difficulty in obtaining information;second,there is a conflict between disclosure and privacy protection;third,the period for storing bad information is unreasonable;fourth,the existence of personal information has been expanded.The problems in the protection of personal information are: first,legislation is inadequate;second,the right system for the protection of personal information is not perfect;third,the supervision is incomplete.Thirdly,it analyzes some of the practices in the disclosure and protection of personal information in the United States and Europe under the credit investigation system,and provides experience for improving China’s existing problems.Finally,it discusses the suggestions for improving the disclosure and protection of personal information in China’s credit investigation system.
