Research On The Legal System Of Sharing Economy Supervision

In recent years,the business model of sharing economy based on the Internet information technology and the transfer of the right to use resources is developing rapidly,and the application fields and models of sharing economy are also developing.In China,the sharing economy has evolved from the initial transfer of the right to use idle goods between individuals to a platform where the business entities transfer and flow the right to use their purchased products in the market at a high speed through Internet technology.This paper focuses on the types of sharing economy in which the business entities use their purchased products for leasing,and in the context of the regulatory legal system,from the economic phenomena such as negative externalities and disordered competition caused by the practical operation of sharing economy in social economy,this paper probes into and discloses the problems existing in the legal system of sharing economy supervision.At present,sharing economy is developing rapidly in China.The main legal problems are weak market access supervision,the rights of consumers are not well protected,lack of legal regulation on credit supervision,and imperfect specialized supervision legal system,etc.,mainly formarket access regulatory weaknesses and market operations in consumer and personal information protection issues.Therefore,through the analysis of sharing economy and the legal system of sharing economy supervision in China,this paper discusses the problems of sharing economy development and legal supervision in China,from the angle of legal system,this paper puts forward some suggestions to perfect the legal supervision system of sharing economy in China: Firstly,we should perfect the market access legal system of enterprises in the sharing economy,establish the unified product access standard,and explore the alternative means of quantity access regulation.Second,improve the protection system for consumers’ rights and interests,protect the safety of consumers’ personal and property,standardize the collection and use of deposits,and improve the Consumer Public Interest Litigation System.Third,establish a credit supervision legal system,improve the personal information protection legal system and establish a unified credit management legal system.Finally,to enhance the hierarchical effectiveness of specific legislation in various subsectors of the sharing economy,to establish a legislative model of consultation and cooperation,and to promote the joint participation of the market and individuals in the governance of market order,so as to maximize the effect of regulatory governance,the purpose of reducing the regulator’s regulatory costs.
